ORDINANCE NS-1003 AMENDING THE SANTA ANA MUNICIPAL <br />CODE BY AMENDING SECTIONS 9-136 AND 9-163 OF <br />DIVISION 1, ARTICLE VI THEREOF RELATING TO FIRE <br />DEPARTMENT THREE-PLATOON SYSTEM <br /> <br /> WHEREAS, the Fire Department of the City of Santa Ana has <br />adopted a three-platoon system and certain amendments are necessary <br />to Sections 9-136 and 9-163 of the Santa Ana Municipal Code to <br />provide for this change; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code is hereby <br />amended by amending Section 9-136 thereof to read in words and <br />figures, as follows: <br /> <br />Sec. 9-136. Same--Shift personnel. <br /> Full-time employees whose regularly scheduled days off <br />are other than Saturday and Sunday shall be entitled to <br />holiday benefits as provided in section 9-135 to be scheduled <br />by the department head. Fire department employees who are <br />regularly at their place of work more than forty (40) hours <br />during a week shall be entitled to five (5) work shifts off <br />during the year in lieu of holidays, to be scheduled by the <br />fire chief. Fire department uniformed personnel working a <br />forty (40) hour week and sworn police personnel who do not <br />take holidays as they occur shall be entitled to twelve (12) <br />working days off during the year in lieu of holidays, to be <br />scheduled by the department head. In the case of sworn <br />police personnel, five (5) of these days shall be taken in <br />conjunction with vacation, to be scheduled by the department <br />head. All other employees of city departments who do not <br />take holidays as they occur shall be entitled to eight (8) <br />working days off during the year in lieu of holidays, to be <br />scheduled by the department head. An employee entitled to <br />time off in lieu of holidays shall receive that time off in <br />proportion to his service at full pay in such capacity during <br />the year. <br /> <br /> SECTION 2: That the Santa Ana Municipal Code is hereby <br />amended by amending Section 9-163 thereof to read in words and <br />figures, as follows: <br /> <br />Sec. 9-163. Limit. <br /> Sick leave with pay may be accumulated to a total of one <br />hundred sixty (160) working days, except as otherwise provided <br />by state law; provided, fire department employees who are <br />regularly at their place of work more than forty (40) hours during <br />a week may accumulate a total of one hundred seventy-four (174) <br />working days in order that the maximum amount of sick leave to <br />be accumulated by them shall be equivalent to that of other <br />employees. In the case of the fire department employees, sick <br />leave shall be charged at the rate of one day for each twelve <br />(12) hours of a regularly scheduled shift. Absence of less than <br />two (2) hours, or less than three (3) hours in the case of such <br />firemen, shall be charged as one-quarter (1/4) day. <br /> <br /> SECTION 3: That this Ordinance shall take effect thirty <br />days from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED BY THE City Council of the City of Santa <br />Ana at its regular meeting held on the 16th day of February, 1970. <br /> <br /> MAYOR <br />CLERK OF THE ~OU'NCIL <br /> <br />-1- <br /> <br /> <br />
