ORDINANCE NS-1113 <br /> <br />AMENDMENT TO CHAPTER 34 OF THE SANTA ANA <br />MUNICIPAL CODE RELATING TO STREET STANDARDS <br /> <br /> WHEREAS, the Planning Commission has given notice of and <br />duly held a public hearing on Planned Residential Development <br />and related private street standards, hereinbelow described; <br />and said commission by its resolution 5967 has recommended <br />approval of said street standard in relation to Planned <br />Residential Development; <br /> <br /> WHEREAS, the City Council regularly held a public hearing <br />on said private street standards as required by law, and does <br />now find that the public necessity, convenience and general <br />welfare require that said private street standards be incor- <br />porated into any Planned Residential Development and that the <br />private street standards as so incorporated will not be detri- <br />mental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1. That Section 34-165 be added to Chapter 34 of <br />the municipal code relating to private street standards for <br />Planned Residential Development, to read in words and figures <br />as follows: <br /> <br />Sec. 34-165. Private street standards for Planned <br /> Residential Development <br /> <br />(1) <br /> <br />Private streets will be allowed in new developments <br />where their use is logically consistent with a desire <br />for neighborhood identification and control of access, <br />and where special overall design concepts may be <br />involved. The use of private streets will be subject <br />to review and approval by the Planning Commission and <br />the City Council. <br /> <br />(2) <br /> <br />Private streets shall be identified as "Private Vehicle <br />Access Ways" rather than bear a street connotation and <br />should be known as "commons." <br /> <br />(3) <br /> <br />Private streets will be permitted only where a satis- <br />factory means of providing for their maintenance and <br />operation is demonstrated. <br /> <br />(4) <br /> <br />The Homeowners' Association shall be required to <br />contract with the City whereby the City can maintain <br />the access way and collect the cost thereof in the <br />event the Association does not maintain them adequately. <br /> <br />The Homeowners' Association constitution, by-laws or <br />covenants-conditions-restrictions shall include acknow- <br />ledgment of the ownership and maintenance responsibility <br />of these private facilities. <br /> <br />(6) The use of private streets as a device for permitting <br /> inadequate design will not be allowed. <br /> <br />(7) <br /> <br />The entire width of the access way should be dedicated <br />to the City as a public utilities easement. <br /> <br />(8) <br /> <br />The use of private streets is limited to cul-de-sacs <br />and to minor local streets not carrying through traffic. <br />Curvilinear or loop street configurations are encouraged. <br /> <br /> <br />
