ORDINANCE NS-l124 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AMENDING CHAPTER 34 PER- <br />TAINING TO SUBDIVISIONS AND ADDING A SECTION <br />TO C~APTER 41 PERTAINING TO PLANNED RESIDEN- <br />TIAL DEVELOPMENT <br /> <br /> WHEREAS, the Planning Commission has given notice of and <br />duly held a public hearing on Planning Residential Development <br />and related private street standards; and said Commission <br />by its Resolution 5967 has recommended certain exceptions and/or <br />waivers to existing subdivision ordinances in relation to planned <br />residential developments; and <br /> <br /> WHERED.S, the City Council regularly held a public hearing <br />on the exceptions and/or waivers to subdivision ordinances re- <br />lating to planned residential developments and published notice <br />as required by law, and does now find that the public necessity, <br />convenience and general welfare require that exceptions and/or <br />waivers to subdivision ordinances relating to planned residential <br />developments allow for certain exceptions and waivers to s~bdi- <br />vision ordinances and that the new classification will not be <br />detrimental to the surrounding property. <br /> <br /> NOW~ THEREFORE~ THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the only exception and/or waiver to the <br />subdivi---s-I~ordinance of Chapter 34, in relation to Planned <br />Residential Development would be that exception and/or waiver <br />contained in Chapter 34, Section 57, to read in words and figures <br />as follows: <br /> <br />Sec. 34-57. Exceptions/Waivers to Subdivision Ordinance <br /> <br />Addition to Sec. 34-57(1) <br /> <br /> Waiver of the provisions of this section may be <br />granted as provided for in Sec. 41-591(0) PRD. <br /> <br /> SECTION 2: That the Planned Residential Development Ordi- <br />nance NS-1112 be amended to read in words and figures: <br /> <br />Sec. 41-591. Addition of paragraph <br /> <br /> When a planned residential development is to be <br />divided for sale, lease or financing through the subdivision of <br />said development, the provisions of Chapter 34-57(1~, Subdivisions, <br />may be waived. A letter requesting waiver of the requirements <br />of Chapter 34-57(1) shall accompany the conditional use permit <br />application and shall include a statement or supporting reason for <br />said waiver request. Said waiver may only be granted in conjunc- <br />tion with the approval of the conditional use permit being applied <br />for. <br /> <br /> SECTION 3: That the Clerk of the Council shall certify to <br />the passage of this Ordinance and cause the same to be published <br />in some daily newspaper printed and published in the City of Santa <br />Ana. <br /> <br /> <br />
