ORDINANCE NO. NS-1261 <br /> <br />AN ORDINANCE OF THE CItY COUNCIL OF THE CITY <br />OF SANTA ANA AMENDING SECTION 5-51 OF THE SANTA <br />ANA MUNICIPAL CODE, DECLARING THE URGENCY THEREOF, <br />AND PROVIDING FOR IMMEDIATE EFFECT PERTAINING TO <br />DOG LICENSING FEES <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: This ordinance is urgently required for the <br />immediate preservation of public peace, health and safety for <br />the reasons that the ordinance (NS-1020) which this ordinance <br />amends required that dog license renewal taxes be paid in ad- <br />vance annually prior to the first day of every July. The <br />Director of Finance must mail dog license renewal notices early <br />in June so that dog license renewal taxes can be paid before the <br />deadline date; such notices have not yet been mailed because <br />this ordinance changes the amount of tax to be levied on dog <br />licenses. Without this ordinance the former ordinance will not <br />effectively protect the health and safety of the citizens of <br />the City. Therefore, the City Council declares that this ordi- <br />nance shall take effect as, and is adopted as, an emergency <br />measure and is to be enforced from the date of its publication. <br /> <br /> SECTION 2: That Section 5-51(a) of the Santa Ana Municipal <br />Code is hereby amended to read as follows: <br /> <br />SECTION 5-51. Taxation - Amount <br /> <br /> (a) A license tax is levied on all dogs over the age of <br />four (4) months owned, kept, harbored, in the custody of, or <br />under the control of any person within the city. Each license <br />fee shall be paid annually, on the first day of July, to the <br />Director of Finance as provided by Resolution of the City <br />Council. Unless otherwise provided by Resolution the full <br />amount shall be paid for any fraction of the licensing year. <br />The Director of Finance may provide for the renewal of dog <br />licenses by mail. <br /> <br /> SECTION 3: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to <br />be invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the vali- <br />dity of the remaining portions of this ordinance. The City <br />Council of the City of Santa Ana hereby declares that it would <br />have adopted this ordinance and each section, subsection, sen- <br />tence, clause, phrase or portion thereof irrespective of the <br />fact that any one or more sections, subsections, sentences, <br />clauses, phrases or portions be declared invalid or unconsti- <br />tutional. <br /> <br /> SECTION 4: Neither the adoption of this ordinance nor the <br />repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed <br />as affecting any of the provisions of such ordinance relating <br />to the collection of any such license or penalty or the penal <br />provisions applicable to any violation thereof, nor to affect <br />the validity of any bond or case deposit in lieu thereof, re- <br />quired to be posted, filed or deposited pursuant to any ordi- <br />nance and all rights and obligations thereunder appertaining <br />shall continue in full force and effect. <br /> <br /> <br />
