REL:nr <br />2-14-77 <br /> <br />ORDINANCE NO. NS- 1349 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />APPROVING AMENDMENT APPLICATION NO. 758 <br />FILED BY M. C. NICKEL REZONING PROPERTY FROM <br />THE R4 (SUBURBAN APARTMENT) DISTRICT TO THE <br />R1 (SINGLE-FAMILY RESIDENCE) DISTRICT, AND <br />AMENDING SECTIONAL DISTRICT MAP 27-5-10 <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. <br />758, filed by M. C. Nickle to rezone property, generally lo- <br />cated on the west side of Greenville Street between Warner and <br />Segerstrom Avenues from the R4 ¢Suburban Apartment) District <br />to the R1 (Single-Family Residence) District, and said Commis- <br />sion has recommended approval of said application; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by <br />law, and does now find that the public necessity, convenience, <br />and general welfare require that the said property be reclassi- <br />fied from the R4 (Suburban Apartment) District to the R1 (Single- <br />Family Residence) District, and that such new classification <br />will not be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property in the City of Santa <br />Ana, County of Orange, California, described as Tract Number <br />8326, Miscellaneous Maps, Book 381, pages 41-42, Records of <br />Orange County, is hereby reclassified from the R4 (Suburban <br />Apartment) District to the R1 (Single-Fa/nily Residence) Dis- <br />trict, and that Sectional District Map 27-5-10 is hereby amended <br />to show said reclassification, in accordance with Exhibit A.A. <br />758-A. <br /> SECTION 2: Neither the adoption of this ordinance nor <br /> the repeal hereby of any ordinance shall in any manner affect the <br /> prosecution for violation of ordinances, which violations were <br /> committed prior to the effective date hereof, nor be construed as <br /> affecting any of the provisions of such ordinance relating to the <br /> collection of any such license or penalty or the penal provisions <br /> applicable to any violation thereof, nor to affect the validity of <br /> any bond or cash deposit in lieu thereof, required to be posted, <br /> filed or deposited pursuant to any ordinance and all rights and <br /> obligations thereunder appertaining shall continue in full force <br /> and effect. <br /> <br /> ADOPTED, this ?th day of March <br /> the following vote: <br /> <br />AYES: <br /> <br />NOES: <br /> <br />ABSENT: <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />COUNCILMEN: Bricken, 0rtiz, Yamamoto, <br /> <br />COUNCILMEN: None <br /> <br /> VICE MAYOR <br /> <br />, 1977, by <br /> <br /> Evans <br /> <br />APPROVED AS TO FORM: <br /> <br />KEITH L.
