NS-2461 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />AMENDING SECTION 41.195.5 OF THE SANTA ANA <br />MUNICIPAL CODE REGARDING TEMPORARY OUTDOOR <br />ACTIVITI ES (ZOA 2000-16) <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: The City Council has reviewed and considered the information <br />contained in the initial study and the negative declaration prepared with respect to this <br />Ordinance. The City Council has, as a result of its consideration, and the evidence <br />presented at the hearings on this matter, determined that, as required pursuant to the <br />California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a <br />Negative Declaration adequately addresses the expected environmental impacts of this <br />Ordinance. On the basis of this review, the City Council finds that there is no evidence <br />from which it can be fairly argued that the project will have a significant adverse effect on <br />the environment. The City Council hereby certifies and approves the negative declaration <br />and directs that the Notice of Determination be prepared and filed with the County Clerk <br />of the County of Orange in the manner required by law. <br /> <br /> SECTION 2: That Section 41-195.5 of Article II of Chapter 41 of the Santa Ana <br />Municipal Code is hereby amended to read as follows (additions to existing code shown <br />in underline and deletions in strike-out): <br /> <br />Sec. 41-195.5. Temporary outdoor activities. <br /> <br /> Notwithstanding any other provision of this chapter, the following activities may <br />be conducted in any C1, CI-MD, C2, C3, C3-A, C4, C5, CD, M1, or M2, CSM, GC, P, <br />SD with commercial use, or SP with commercial use district and are not required to be <br />carried on within an enclosed building, provided they are carried on in accordance with <br />the limitations hereinafter set forth, and provided a land use certificate is first obtained <br />in accordance with sections 41-675 through 41-677: <br /> <br />(a) Bazaars, fiestas, fairs, parties, receptions, shows, festivals and fund-raising <br />events, provided the activities do not occur on the same lot more frequently than <br />six (6) days in any one-year period, do not continue on the same lot for more than <br />three (3) successive days, do not begin earlier than 10:00 a.m. cc ,~,,, -~, ...... <br />tha~ ~"~" ~'~ ~ ~ ~""~ .....~ dc ~* ~+~ ....... * ~'~ p m ~ <br /> ...... ~ CF .....
