ORDINANCE NO. NS-2498 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AMENDING SPECIFIC DEVELOPMENT 65 <br />ZONING DISTRICT (DISCOVERY SCIENCE CENTER) <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA ORDAINS AS FOLLOWS: <br /> <br />Section 1. The City Council hereby finds, determines and declares as follows: <br /> <br />In 1997, pursuant to the authority of section 41-493 of the Santa Ana <br />Municipal Code, the City established Specific Development (SD) 65, a <br />zoning district. <br /> <br />SD 65 was created for the express purpose of establishing land use <br />regulations and standards for the affected property, commonly known as <br />the Discovery Science Center. The City Council now desires to amend SD <br />65, to add new proposed uses to the north parcel and changes to the <br />proposed IMAX or large screen theater. <br /> <br />The Planning Commission has, following a noticed public hearing, on March <br />25, 2002 recommended approval of these amendments to SD. <br /> <br />The City Council has held a noticed public hearing on this Ordinance, and <br />has considered all testimony presented thereto. <br /> <br />In conjunction with this project, the City Council has previously certified <br />Final Environmental Impact Report No. 96-01 and its Addendum. <br /> <br /> Section 2. <br />1 hereto. <br /> <br />SD 65 is hereby approved and adopted to read as set forth in Exhibit <br /> <br /> Section 3. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this ordinance. The City Council of the City of Santa Ana hereby declares that <br />it would have adopted this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or more sections, <br />subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br /> <br />ADOPTED this 6th day of May, 2002. <br /> <br /> Page 1 of 10 <br />Ordinance No. NS-2498 <br /> <br /> <br />
