NS-2504 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING <br />CHAPTER 31 ADDING SECTION 31-5, TO THE SANTA ANA <br />MUNICIPAL CODE REGARDING THE ESTABLISHMENT OF <br />RULES AND GUIDELINES AT PUBLIC SKATE PARK <br />FACILITIES <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br />SECTION 1: The City Council hereby finds, determines and declares: <br /> <br />The City of Santa Ana desires to provide alternative avenues of recreation <br />within the City. <br /> <br />Skateboarding and in-line skating, is a form of recreation that has increased <br />in popularity within Santa Ana in recent years. <br /> <br />Skateboarding is considered a hazardous recreational activity, as defined in <br />California Government Code section 831.7. <br /> <br />The increased popularity of the sports has resulted in skating on public <br />streets and right of ways within the City. <br /> <br />The State of California requires that all cities that have skate parks adopt an <br />ordinance requiring any person skating in a city-owned facility must wear <br />proper safety gear. <br /> <br />The City desires to operate public skate facilities to address the recreational <br />needs of the community, while providing a safe area for skaters. <br /> <br />All provisions of the Santa Ana Municipal Code which are repeated herein <br />are repeated solely in order to comply with the provisions of section 418 of <br />the Charter of the City of Santa Ana. Any such restatement of existing <br />provisions of the Code is not intended, nor shall it be interpreted, as <br />constituting a new action or decision of the City Council, but rather such <br />provisions are repeated for tracking purposes only in conformance with the <br />Charter. <br /> <br /> SECTION 2: That Section 31-5 is hereby added to the Santa Ana Municipal Code <br />to read as follows: <br /> <br />Ordinance No. 2504 <br /> Page 1 of 4 <br /> <br /> <br />
