When originally dedicated, the easements were intended to <br />provide the City with the appropriate right of way at a planned <br />driveway. However, the driveway was not constructed, and the applicant <br />has reconfigured the site plan to eliminate the proposed driveway. The <br />Planning Commission approved the site plan on September 27, 2004. <br /> <br />The easements are not needed for public purposes and have not been used <br />by the public within the past five years. Private utilities companies, <br />other government agencies, and City Departments have been contacted and <br />reviewed this street vacation request as to potential impacts. No <br />adverse impacts were reported to the Public Works Agency. <br /> <br />There are no City or public owned utilities within the vacated area. <br />However, a fi ve- foot wide sidewalk and public utility easement behind <br />new the right-of-way alignment will be reserved. Drainage and traffic <br />circulation will not be impacted by the vacation. <br /> <br />ENVIRONMENTAL IMPACT <br /> <br />In accordance with the California Environmental Quality Act, the proposed <br />proj ect is exempt from further review. Categorical Exemption ER No. <br />2004-223 will be filed for this report. <br /> <br />12A-1 <br />
