DISCUSSION First American Title Company of Santa Ana has requested that the City vacate a portion of a street easement and a sidewalk and public utility easement adjacent to the vacant lot at 8 First American Way East (Exhibit 1). When originally dedicated, the easements were intended to provide the City with the appropriate right of way at a planned driveway. However, the driveway was not constructed, and the applicant has reconfigured the site plan to eliminate the proposed driveway. The Planning Commission approved the site plan on September 27, 2004. The easements are not needed for public purposes and have not been used by the public within the past five years. Private utilities companies, other government agencies, and City Departments have been contacted and reviewed this street vacation request as to potential impacts. No adverse impacts were reported to the Public Works Agency. There are no City or public owned utilities within the vacated area. However, a fi ve- foot wide sidewalk and public utility easement behind new the right-of-way alignment will be reserved. Drainage and traffic circulation will not be impacted by the vacation. ENVIRONMENTAL IMPACT In accordance with the California Environmental Quality Act, the proposed proj ect is exempt from further review. Categorical Exemption ER No. 2004-223 will be filed for this report. 12A-1
