<br />. <br /> <br />8 <br /> <br />. <br /> <br />RESOLUTION NO. 98- 15 <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA APPROVING AN <br />AGREEMENT BETWEEN THE AGENCY AND SSF, INC. FOR THE <br />SALE AND DEVELOPMENT OF CERTAIN PROPERTY IN THE <br />SOUTH MAIN STREET REDEVELOPMENTPROJECT <br /> <br />WHEREAS, the. Community Redevelopment Agency of the City of Santa Ana (hereinafter <br />referred to as the "Agency") is engaged in activities necessary to execute and. implement the <br />Redevelopment Plan for the Santa Ana South Main Street Redevelopment Project (the "Project Area"); <br />and <br /> <br />WHEREAS, in order to implement the Redevelopment Plan, the Agency proposes to sell certain <br />real property in the Project Area, pursuant to the terms and conditions of that certain Disposition and <br />DevelopmentAgreement (hereinafter referred to as the "Agreement") between the Agency and SSF, INC. <br />(the "Developer"), which is on file in the office of the Executive Director of the Agency, in which said <br />real property (hereinafterreferred to as the "Site") is described; and <br /> <br />WHEREAS, the Developer bas submitted to the Agency a written offer to purchase the Site in the <br />form of the Agreement; and <br /> <br />WHEREAS, the Agreement contains all of the provisions, terms, conditions and obligations <br />required by the state and local laws; and <br /> <br />WHEREAS, pursuant to the provisions of the California RedevelopmentLaw, the Agency and the <br />City Council have held a duly noticed joint public hearing on the proposed sale of the Site pursuant to the <br />Agreement; and <br /> <br />WHEREAS, the Agency has reviewed and considered the information contained in the initial <br />study and the negative declaration prepared with respect to the Agreement, and as a result of its <br />consideration, and the evidence presented at the hearings on this matter, determined that, as required <br />pursuant to the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a <br />negative declaration adequately addresses the expected environmental impacts of the Agreement, such <br />that, the Agency finds that there is no evidence from which it can be fairly argued that the project will <br />have a significant adverse effect on the environment; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA, AS FOLLOWS: <br /> <br />I. The Agency hereby certifies and approves the negative declaration prepared in conjunction <br />with the Agreement and directs that the Notice of Determination be prepared and filed with the County <br />Clerk of the County of Orange in the manner required by law. <br /> <br />2. The Agency bas considered all terms and conditions of the proposed sale and the Summary <br />Report, and hereby finds and determines that the redevelopment of the Site pursuant to the Agreement is <br />
