<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />REL:rs <br />9-21-76 <br /> <br />RESOLUTION NO. 76-26 <br /> <br />A RESOLUTION OF THE COMMUNITY REDEVELOPMENT <br />AGENCY OF THE CITY OF SANTA ANA GRANTING A <br />VARIANCE FROM THE REDEVELOPMENT PLAN FOR THE <br />DEVELOPMENT OF LOW AND MODERATE INCOME APART- <br />MENT HOUSING IN THE AREA BOUNDED BY FIRST, <br />FLOWER, THIRD AND ROSS STREETS. <br /> <br />BE IT RESOLVED by the Community Redevelopment <br />Agency of the City of Santa Ana as follows: <br /> <br />1. That it is hereby determined that exceptional cir- <br />cumstances exist to grant a variance, and a variance is hereby <br />granted, to the Community Redevelopment Agency of the City of <br />Santa Ana and to its successors and assigns in interest, from <br />the limits, restrictions and controls of the Redevelopment Plan <br />for the C~ty of Santa Ana Redevelopment Project Area, for that <br />land presently owned by or hereafter to be acquired by the said <br />Community Redevelopment Agency which is located within an area <br />bounded on the south by First Street, on the West by Flower Street, <br />on the North by Third Street and on the east by Ross Street, in the <br />City of Santa Ana; <br /> <br />2. That the proposed variance, as hereinafter conditioned, <br />will be compatible with the standards and ~equirements set forth in <br />the said Redevelopment Plan; <br /> <br />3. The modifications in the variance necessary in order <br />to meet the requirements of the said Redevelopment Plan are as <br />follows: <br /> <br />(a) The variance is granted upon the con- <br />dition that the said Community Redevelopment <br />Agency enter into an agreement with a developer <br />providing for the disposition and development <br />of the subject property as a combination of <br />approximately 199 units of low-rent apartment housing <br />and 300 units of market rate apartment housing <br />for low-and moderate-income families; that such <br />agreement contain specific provisions governing <br />the design and improvement of such development; <br />and. that development be in accordance with such <br />provisions; and <br /> <br />(b) The variance is granted upon the <br />additional condition that the City of Santa Ana <br />rezone the subject property to the SD (Specific <br />Development) use district and adopt a specific <br />development plan for the development of said <br />property; and that development be in accordance <br />with such plan. <br /> <br />4. That the said Community Redevelopment Agency has not <br />at this time entered into an agreement for the development of <br />improvements in accordance with the variance and submitted plans, <br />but intends to do so in accordance with the condition hereinabove <br />set forth; <br /> <br />5. That this variance and the conditions herein are <br />necessary to protect the pub1tc health, safety and welfare of the <br />citizens of the City of Santa Ana. <br /> <br />c.RA 5-1 <br />
