This serves as an agreement betwcen the City of Santa Ana {"City} and Time v a ~ . ~,~„~~ Warner SoCal News ("Producer"), as of November ~ , 2008, in connecticn with the news program produced by Producer. N-2008-155 2. The City hereby authorizes Producer to film activities and personnel as pern^it*~ed by the Santa Ana Police Department on or off its premises for the creation of a news program. All of the Producer's filming activity will be subject to and under the control of the T]epartmenl officer in charge. s. The rough cut of any footage to be used. for the news program that the Producer intends to use shall be submitted to Commander Tammy Franks of the Santa Axta Police Department. Within ten days, City shall notifj+ Producer in writing of any scenes which are to be excluded from the news program by listing such scenes on a £otrtr provided by the Producer to the City that identifies the date, officer, description and time code of such scenes. Producer shall exclude such scenes from the news program. 4. The use of any footage containing public figures shall require Producer to obtain appropriate clearances from such individuals. Producer shall also obtain the appropriate appearance agreement and release of any and all participants in the news program. S. Producer agrees to indemnify and hold harmless the City is connection with arty and all claims arising out of the actions of Producer's personnel, agents, employees.. contractors or authorized third parties in connection. with the filming andlor produrtion of the news program; including Producer's breach of this agreement, 6. Producer shalt obtain all permits required by the City for filming in the City, including but not limited to film permits, special event permits or licenses. 7. Producer's personnel, agents, employees, contractors or authorized third parties shall sign "Ride-A-Long" waivers if they will be in any Santa Ana Police Department vehicles. b.
