<br />ORDINANCE NO. NS-2780 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AMENDING SECTIONS 30-6 AND 30-8 <br />OF THE SANTA ANA MUNICIPAL CODE AUTHORIZING <br />IMPOSITION OF FEES FOR AN APPLICANT SEEKING <br />APPROVAL FOR A MAJOR EXTERIOR MODIFICATION <br />TO A HISTORIC STRUCTURE <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. Since 2003, the City has required review and approval of any person's <br />request to make substantial physical exterior modifications to a structure <br />listed on the City's list of historic resources. <br /> <br />B. In some cases, the City's review of such applications have involved <br />extensive research, use of outside historic experts, and multiple public <br />hearings, including public hearings before the City Council on appeal. <br /> <br />C. In other cases, which do not involve proposed substantial exterior <br />modifications, the City has established procedures for administrative <br />approval of modification requests by city staff which eliminates the need <br />for applications, extensive review or any public hearings. <br /> <br />D. It is appropriate for the City to impose a reasonable application processing <br />fee on individual property owners who are seeking approval by the City to <br />make substantial physical exterior modifications to historic structures. <br /> <br />E. All provisions of the Santa Ana Municipal Code which are repeated herein <br />are repeated solely in order to comply with the provisions of section 418 of <br />the Charter of the City of Santa Ana. Any such restatement of existing <br />provisions of the Code is not intended, nor shall it be interpreted, as <br />constituting a new action or decision of the City Council, but rather such <br />provisions are repeated for tracking purposes only in conformance with <br />the Charter. <br /> <br />Section 2. The City Council has reviewed and considered the information <br />contained in the initial study and the negative declaration prepared with respect to this <br />Ordinance. The City Council has, as a result of its consideration and the evidence <br />presented at the hearings on this matter, determined that, as required pursuant to the <br />California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a <br /> <br />Ordinance No. NS-2780 <br />Page 1014 <br />
