RESOLUTION NO. 97-19 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVLNG <br />VARIANCE NO. 97-12 TO GRANT RELIEF FROM <br />PARKING AND FREESTANDING SIGN <br />REQUIREMENTS FOR THE VALLEY SHOPPING <br />CENTER LOCATED AT 5015-5127 WEST EDINGER <br />AVENUE <br />WHEREAS, this Commission held a public hearing on October 13, <br />1997, on Variance Application No. 97-12, to allow a variance from <br />the parking and freestanding sign requirements imposed by the Santa <br />Ana Municipal Code for an existing shopping center located at 5015- <br />5127 West Edinger Avenue; <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid <br />hearing, this Commission finds and determines as follows: <br />A. That because of special circumstances applicable to the <br />subject property, including size, shape, topography, location or <br />• surroundings, the strict application of the zoning ordinance is <br />found to deprive the subject property of privileges not otherwise <br />at variance with the intent and purpose of the provisions of this <br />chapter. <br />As shown in the attached plans, the existing shopping center <br />is a built-out facility that cannot be designed to accommodate <br />additional parking. To preserve the viability of the center and <br />allow the re-use of the structures, it is appropriate to grant the <br />parking variance for retail uses. The granting of the variance <br />will provide the applicant the opportunity to utilize the center in <br />a manner consistent with other nonconforming facilities. The <br />approval of the sign variance will permit the installation of signs <br />consistent with similar shopping centers granted variances for free <br />standing signs. <br />B. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights; <br />The granting of the variance will preserve the applicant's <br />ability to lease the shopping center for uses in keeping with the <br />General Commercial (C1) district regulations and thereby allow the <br />applicant to maintain the economic viability of the center. <br />C. That granting of a variance will not be materially <br />detrimental to the public welfare or injurious to surrounding <br />1 <br />
