• <br />RESOLUTION NO. 2010-03 <br />ROH - 9/23/10 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA ADOPTING MINOR <br />EXCEPTION NO. 2010-01 TO ALLOW ASIX-FOOT TALL <br />WROUGHT IRON FENCE AT 801 EAST FIRST STREET <br />BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Zoning Administrator of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Applicant is requesting approval of Minor Exception No. 2010-01 to allow <br />a six-foot tall wrought iron perimeter fence for a child care center located <br />at 801 East First Street. <br />• <br />B. The applicant is requesting relief from Section 41-610(a) of the Santa Ana <br />Municipal Code (SAMC), which establishes the maximum height of walls <br />and fences to four feet in height where the wall or fence extends into the <br />required front yard or any required landscape area. <br />C. Minor Exception No. 2010-01 came before the Zoning Administrator of the <br />City of Santa Ana for a public hearing on September 1, 2010. At the <br />request of the applicant, the hearing was continued at that time by the <br />Zoning Administrator to the regular meeting of September 15, 2010. <br />However, in order to provide the necessary public notice, the hearing for <br />September 15, 2010, was taken off calendar and re-scheduled for the <br />regular meeting of September 23, 2010. Thereafter, Minor Exception No. <br />2010-01 came before the Zoning Administrator of the City of Santa Ana for <br />a duly noticed public hearing on September 23, 2010 <br />D. Santa Ana Municipal Code Section 41-638 authorizes the Zoning <br />Administrator to grant a minor exception upon making certain findings. <br />1. That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location, or <br />surroundings, the strict application of the zoning ordinance is found <br />to deprive the subject property of privileges not otherwise at variance <br />with the intent and purpose of the provisions of this chapter. <br />• <br />Due to the unique location on a corner lot along a busy <br />arterial street, denial of the minor exception variance would <br />deprive the property owner the privilege of utilizing the facility <br />to its maximum potential in order to ensure the privacy and <br />Resolution No. 2010-03 <br />Page 1 of 5 <br />
