• <br />• <br />ROH — 8/20/08 <br />RESOLUTION NO. 2008 -12 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA APPROVING MINOR <br />EXCEPTION NO. 2008 -02 TO ALLOW A SECOND <br />DWELLING UNIT WITH REDUCED SETBACK AND <br />INCREASED HEIGHT AT 2412 NORTH VALENCIA STREET <br />BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Zoning Administrator of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Applicant is requesting approval of Minor Exception No. 2008 -02 to <br />construct a second dwelling unit at the property located at 2412 North <br />Valencia Street, that does not meet Santa Ana Municipal Code Section <br />41 -194, including: <br />1. A side yard setback of three feet at the rear of the lot rather than <br />the five feet as required by the Santa Ana Municipal Code. <br />2. Exceeding the height requirement of 15 feet by having an <br />accessory structure that is 16 feet in height. <br />B. Minor Exception No. 2008 -02 came before the Zoning Administrator of the <br />City of Santa Ana for a public hearing on August 20, 2008. <br />C. Section 41 -194 of the Santa Ana Municipal Code (SAMC) contains the <br />second dwelling unit standards, including: <br />1. SAMC Section 41- 194(g) which states "Each side yard shall be a <br />minimum of five (5) feet for the second dwelling unit." <br />2. SAMC Section 41- 194(k) which states "The height of a detached <br />second dwelling unit shall not exceed fifteen (15) feet." <br />D. Santa Ana Municipal Code Section 41 -638 authorizes the Zoning <br />Administrator to grant a minor exception from the provisions of the Santa <br />Ana Municipal Code. The Zoning Administrator determines that the <br />following findings have been established: <br />1. That because of special circumstances applicable to the subject <br />is property, including size, shape, topography, location or <br />surroundings, the strict application of the zoning ordinance is found <br />Resolution No. 2008 -12 <br />Page 1 of 4 <br />
