ZONING ADMINISTRATOR HEARING <br />MINUTES <br />NOVEMBER 25, 2009 <br />MINOR EXCEPTION NO. 2009 -05 <br />10:39 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Perry Burch, Applicant; Nancy Aceves and Lucila Iniguez, <br />Residents; Willie Huh, Business Owner; Vince Fregoso, Principal Planner; Martha <br />Ramirez, Commission Secretary; and Jocelyn Magalona, Recording Secretary. <br />There were no written communications. <br />Vince Fregoso presented the staff report and recommendation. Mr. Fregoso added a <br />condition requiring the recordation of a lot merger prior to issuance of the building <br />permit. <br />Martha Ramirez and Lucila Iniguez provided translation in Spanish for Ms. Aceves, a <br />resident at 1234 West Cubbon. <br />Ms. Iniguez stated her concern regarding the wall on the side of the residence, noise, <br />alcohol and hours of operation. <br />Discussion and clarification followed concerning the wall and the outdoor patio area. <br />Mr. Klotz stated the decision before him is the encroachment of the building into the <br />side yard setback. He explained the different process for the ABC license and hours of <br />operation. <br />Mr. Klotz added three more conditions requiring a temporary fence during construction, <br />restriction of audible music or noise beyond the patio area, and a fence around the patio <br />area. <br />The Zoning Administrator adopted a resolution approving Minor Exception No. 2009 -05 <br />with the amended conditions. <br />The hearing adjourned at 10:13 a.m. <br />ocelyn Mag Iona <br />Recording Secretary <br />rnnzoning administratioMminutes 12009 \11 -25 -09 ME09 -05 Quintero Project <br />
