REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />OCTOBER 7, 2014 <br />TITLE: <br />CIVIC CENTER — JOINT POWERS <br />AGREEMENT AMENDMENT AND <br />RESTATEMENT BETWEEN THE CITY OF <br />SANTA ANA AND THE COUNTY OF <br />ORANGE {STRATEGIC PLAN NO. 6, 1B} <br />t <br />CITY MANAG . <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />i* 1 <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 18' Reading <br />❑ Ordinance on 2"' Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO 10/21/2014 <br />Meeting not convened on 10/7/2014 <br />FILE NUMBER due to unforeseen circumstances <br />Authorize the City Manager and Clerk of the Council to execute an amendment and restatement <br />of the Civic Center Joint Powers Agreement between the City of Santa Ana and the County of <br />Orange, for a period of ten years with ten year extensions upon mutual agreement from the <br />effective date of the amendment and restatement, subject to non - substantive changes approved <br />by the City Manager and the City Attorney. <br />DISCUSSION <br />On January 17, 1966, the County of Orange and the City of Santa Ana entered into a Joint <br />Exercise of Powers Agreement forming an Orange County Civic Center Authority for the purpose <br />to plan, construct and maintain a comprehensive Civic Center in Santa Ana. Under the initial <br />terms of this agreement, the County and City deeded land to the Authority to develop the Civic <br />Center. The Joint Powers Agreement has served both agencies successfully to develop and <br />maintain the Civic Center. The original Joint Powers Agreement is for a 50 -year term and will <br />expire on January 2016. <br />Through the years, the Joint Powers agreement has been amended six times: 1) in June 1970, to <br />address conveyance of property to develop City Hall; 2) in December 1970 to make available <br />steam and chilled water to the City; 3) in December 1984, to quitclaim the Orange County Men's <br />Jail and the Intake /Release Center to the County; 4) in November 1991, to grant deed the Men's <br />Jail and the Intake /Release Center to the County; 5) in February 1994, to quitclaim back to the <br />City and the County all the remaining parcels owned by the Authority; and 6) on July 20, 1999 to <br />modify the minimum of meetings held annually. <br />The proposed amendment and restatement of the Joint Powers Agreement will extend the term <br />for ten years, with ten -year extensions upon mutual agreement, thereafter. Either party may <br />terminate the agreement at any time with a 180 -day written notice. The amendment will also <br />simplify and update the purpose, powers and governance of the Authority. The prior <br />amendments to the Joint Powers agreement will be simplified and prior land grants, which are <br />now irrelevant, will be omitted. <br />25A -1 <br />
