LS 3.28.16 <br />RESOLUTION NO. 2016-12 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. <br />2016-07 AS CONDITIONED TO ALLOW A DRIVE-THROUGH FOR <br />THE PROPERTY LOCATED 3325 SOUTH HARBOR BOULEVARD <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. Applicant is requesting approval of Conditional Use Permit No. 2016-07 to allow a <br />drive-through in the Light Industrial (M-1) zoning district at the property located at <br />3325 South Harbor Boulevard. <br />B. Santa Ana Municipal Code Section 41-472.5(g) requires approval of a conditional <br />use permit to allow eating establishments with drive-through window service in the <br />Light Industrial (M-1) zoning district. <br />C. On March 28, 2016, the Planning Commission held a duly noticed public hearing on <br />Conditional Use Permit No. 2016-07. <br />D. The Planning Commission of the City of Santa Ana determines that the following <br />findings, which must be established in order to grant this Conditional Use Permit <br />pursuant to Santa Ana Municipal Code (SAMC) Section 41-472.5(g), have been <br />established for Conditional Use Permit No. 2016-07 to warrant approval of the <br />conditional use permit to allow a drive-through: <br />1. That the proposed use will provide a service or facility which will contribute to <br />the general well-being of the neighborhood or community. <br />The proposed eating establishment with drive-through window service <br />will provide a service to the community. The proposed eating <br />establishment with drive-through window service is a use that is <br />supportive to the primary industrial uses in the area. The use will <br />provide dining opportunities to those working in the immediate area <br />and will provide employment opportunities to residents that live in the <br />city. The drive-through window service will provide a convenient <br />option for patrons purchasing meals at the restaurant. <br />2. That the proposed use will not, under the circumstances of the particular case, <br />be detrimental to the health, safety, or general welfare of persons residing or <br />working in the vicinity. <br />Resolution No. 2016-12 <br />Page 1 of 6 <br />
