UCAB 82- 3 <br />Page Two <br />Attorney's office to prePare and submit to the Board a <br />resolution formalizing the Boardr s intended decision. <br />NOW, THEREFORE, BE IT RESOLVED BY THE IJNIFORM CODE <br />APPEALS BOARD OF THE CITY OA SANTA ANA AS FOLLOWS: <br />1. Based uPon the evidence submitted at the aforesaid <br />public hearing, this Board finds and determines anil makes <br />the following findings of fact: <br />(a) The actual occupant load of APpellantsr real <br />property is less than one hundred (100) persons; <br />(b) Hourly occuPancy calculations made by Appellants <br />and submitted to the Board' for the months of January, 1982, <br />February, l-982, Irlarch, 1982 and April, 1982, show that the <br />average number of PeoPle (including customers and employees) <br />per hour in Appellantsr store during January, 1982, was 8.45 <br />personsi 9.32 persons during February, 1982; 9.45 persons <br />during March, 1982; and 9.66 persons during Apri1, 1982. <br />(c) Further calculations performed by APPeI-lants <br />and submitted to the Board show that for the five (5) day <br />period of May L2-16, 1982, the average hourly occupancy in <br />Appellants' store during said five (5) day period was 8.57 <br />persons and that the highest actual occupancy, at any one <br />time during said five (5) day period, was 10 persons. <br />(d) As further findings of fact in support of its <br />decision, this Board adoPts, and hereby incorPorates by <br />reference as if fuI1y set forth at this Point, the May 20, <br />1982 report submitted to the Board by Appellants' counsel, <br />Michael J. Steponovich, Jr., Esq. <br />2. Effective May 20, 1982, appellants' real property <br />tocated at 505 South Main street is hereby reclassified from <br />the Class II (High Risk) to the Ctass III (Medium Risk) <br />category, for al,1 purposes of comptyj.ng with the cityrs <br />Seismic Safety Ordinance. <br />3. This Board reserves the continuing right and <br />jurisdiction to review its decision in this regard should <br />future events, such a change of use in all or any Portion of <br />Appellants' real property, require that this Board hold <br />anotner duly noticed public hearing, vrith at least ten (10)
