<br />MATERIAL AND WORKMANSHIP
<br />1.UNLESS OTHERWISE SPECIFICALLY PROVIDED IN THESE DOCUMENTS, ALL EQUIPMENT, MATERIAL, AND ARTICLES
<br />INCORPORATED IN THE WORK COVERED BY THESE DOCUMENTS ARE TO BE NEW AND OF THE MOST SUITABLE GRADE
<br />FOR THE PROCESS INTENDED.
<br />CONTRACTOR SHALL NOT DEVIATE FROM MATERIALS OR PRODUCTS SPECIFIED UNLESS THROUGH MUTUAL AGREEMENT WITH THE OWNER'S
<br />CONSTRUCTION MANAGER APPROVAL MUST BE IN WRITING, SIGNED BY OWNER'S CONSTRUCTION MANAGER SUBSTITUTE MATERIALS SHALL BE

<br />PERFORMANCE, CAPABILITY, NATURE, AND RATING OF THE MACHINERY, MECHANICAL AND OTHER EQUIPMENT,
<br />MATERIAL OR ARTICLES WHICH THE CONTRACTOR CONTEMPLATES INCORPORATING IN THE WORK WHEN REQUIRED BY
<br />THE OWNER'S REPRESENTATIVE.
<br />4.MACHINERY, EQUIPMENT, MATERIAL, AND ARTICLES INSTALLED OR USED WITHOUT REQUIRED WRITTEN APPROVAL
<br />SHALL BE AT THE RISK OF SUBSEQUENT REJECTION.
<br />5.CONTRACTOR TO PROVIDE ALL MATERIALS NOT LISTED ON THE OWNER'S SUPPLIED EQUIPMENT LIST, BUT REQUIRED
<br />FOR A COMPLETE AND OPERATING FUEL STORAGE AND DISPENSING SYSTEM.
<br />6.CONTRACTOR IS RESPONSIBLE FOR COORDINATING, RECEIVING AND UNLOADING THE ENTIRE OWNER'S SUPPLIED
<br />EQUIPMENT DELIVERED TO CONTRACTORS WAREHOUSE, OR JOB SITE. THE SECURING OF EQUIPMENT REMAINS THE
<br />CONTRACTOR'S RESPONSIBILITY UNTIL THE PROJECT RETAINAGE IS PAID. CONTRACTOR TO DISTRIBUTE ALL RECEIVING
<br />DOCUMENTS TO THE OWNER'S CONSTRUCTION MANAGER.
<br />7.ALL WORK TO BE DONE IN ACCORDANCE WITH APPLICABLE CODES AND REGULATIONS.
<br />8.ALL MATERIALS SHALL BE INSTALLED PER MANUFACTURER'S INSTRUCTIONS AND THESE DOCUMENTS. CONFLICTS SHALL
<br />BE BROUGHT TO THE ATTENTION OF THE OWNER'S REPRESENTATIVE.
<br />9.IF ANY OF THESE DOCUMENTS INDICATE A CONFLICT WITH THE STATE OR LOCAL REQUIREMENTS AS ARE CURRENTLY IN
<br />EFFECT AT THE TIME OF THIS PROJECT, IT IS EXPECTED THAT THE MOST RESTRICTIVE CONDITION(S) WOULD APPLY.
<br />GENERAL CONDITIONS
<br />1.CONTRACTOR EMPLOYEES SHALL HAVE COMPLETED 40 HOURS OCCUPATIONAL SAFETY & HEALTH ADMINISTRATION
<br />(OSHA) TRAINING COURSE PRIOR TO THE START OF WORK CERTIFICATION OF THIS MUST BE PROVIDED TO THE OWNER'S
<br />REPRESENTATIVE PRIOR TO THE START OF WORK.
<br />2.CONTRACTOR EMPLOYEES SHALL HAVE COMPLETED THE EQUIPMENT (INCLUDING, BUT NOT LIMITED TO, TANK, PIPING,
<br />SUMPS, DISPENSERS, MONITORING) MANUFACTURER'S TRAINING REQUIREMENTS IN ACCORDANCE WITH, BUT NOT
<br />LIMITED TO, CALIFORNIA UNDERGROUND STORAGE TANK (UST) REGULATIONS AND CALIFORNIA AIR RESOURCES BOARD
<br />(CARB) REQUIREMENTS. CERTIFICATES SHALL BE PROVIDED TO OWNER. CONTRACTOR SHALL COMPLETE THE
<br />INSTALLATION CHECKLISTS SUPPLIED BY MANUFACTURERS AND SHALL FURNISH THE CHECKLISTS TO OWNER.
<br />3.CONTRACTOR SHALL HAVE THE FOLLOWING LICENSES:

<br />B:HAZARDOUS MATERIAL SUBSTANCE HANDLING (HAZ)
<br />4.CONTRACTOR SHALL HAVE THE FOLLOWING INSURANCE. CONTRACTOR SHALL HAVE PROOF OF SUCH INSURANCE ON FILE
<br />WITH OWNER BY NAMING OWNER AS "ADDITIONAL INSURED."
<br />A:STATUTORY WORKMAN'S COMPREHENSIVE LIABILITY
<br />B:COMPREHENSIVE GENERAL LIABILITY, WITH A COMBINED SINGLE LIMIT OF NOT LESS THAN $1,000,000 PER OCCURRENCE FOR BODILY INJURY
<br />AND PROPERTY DAMAGE.
<br />C:AUTOMOBILE LIABILITY COVERING USE OF ALL OWNED OR HIRED VEHICLES WITH A COMBINED SINGLE LIMIT OF LIABILITY OF NOT LESS THAN
<br />$1,000,000 PER OCCURRENCE FOR BODILY INJURY AND PROPERTY DAMAGE.
<br />5.CONTRACTOR TO FURNISH ALL LABOR, MATERIAL, EQUIPMENT, AND SERVICES NECESSARY FOR OR REASONABLY
<br />INCIDENTAL TO THE SATISFACTORY COMPLETION OF ALL WORK SHOWN ON, CALLED FOR OR REQUIRED BY THE
<br />DRAWINGS, EXCEPT AS NOTED AS SUPPLIED BY OWNER OR OTHERS.
<br />6.ALL WORK SHALL BE PERFORMED IN ACCORDANCE WITH THE CALIF. BUILDING CODE, CALIFORNIA FIRE CODE, CALIF.
<br />ELECTRICAL CODE. CALIF. UNDERGROUND STORAGE TANK REGULATIONS. OSHA CONSTRUCTION SAFETY ORDERS,
<br />NATIONAL FIRE PROTECTION ASSOC. (NFPA), UNDERWRITER'S LABORATORIES, INC. (UL), CARB EXECUTIVE ORDERS AND
<br />GUIDANCE LETTERS AND ANY OTHER APPLICABLE STANDARD OR STATE REGULATION, COUNTY OR CITY ORDINANCES.
<br />7.All PETROLEUM PERMITS TO BE SECURED BY OWNER OR OWNER'S AGENT AND SUPPLIED TO THE CONTRACTOR WHO IS
<br />RESPONSIBLE FOR COMPLYING WITH All PERMIT CONDITIONS. CONTRACTOR SHALL SECURE MISCELLANEOUS ELECTRICAL
<br />PERMIT UNLESS WORK IS COVERED BY OTHER BUILDING PERMITS FOR THE PROJECT.
<br />8.CONTRACTOR SHALL VISIT SITE AND FAMILIARIZE HIMSELF OF ALL EXISTING CONDITIONS PRIOR TO START OF
<br />CONSTRUCTION.
<br />9.CONTRACTOR SHALL PROTECT ALL EXISTING FACILITIES TO REMAIN UNLESS NOTED OTHERWISE. CONTRACTOR SHALL
<br />REPAIR OR REPLACE TO THE SATISFACTION OF THE OWNER'S REPRESENTATIVE ANY EXISTING FACILITIES THAT ARE
<br />DAMAGED BV THE CONTRACTOR'S OPERATIONS.
<br />10.CONTRACTOR SHALL KEEP THE SITE FREE OF WASTE AND RUBBISH AT ALL TIMES CONTRACTOR SHALL HAVE THE WORK
<br />AREA PROFESSIONALLY CLEANED THE DAY BEFORE THE OWNER'S FINAL PROJECT INSPECTION.
<br />11.WHEN AN INSTALLATION IS MADE AT AN EXISTING STORE, THE CONTRACTOR IS TO SCHEDULE ANO PERFORM HIS WORK
<br />SO AS NOT TO INTERFERE WITH THE NORMAL STORE OPERATIONS. ALL DEBRIS, EXCESS EXCAVATION MATERIALS,
<br />MACHINERY AND EQUIPMENT TO BE REMOVED AND MAINTAINED CLEAR OF THE DRIVEWAYS THAT ARE IN USE EACH
<br />DAY & LIGHTED BARRICADES SHALL BE PROVIDED FOR THE PUBLIC'S PROTECTION. WHEN IT BECOMES NECESSARY TO
<br />CLOSE A DRIVEWAY FOR MORE THAN 24 HOURS, THE CONTRACTOR Will PROVIDE TEMPORARY TRAVEL SERVICE FOR
<br />TRAFFIC.
<br />12.A COPY OF THE SPECIFICATIONS AND DRAWINGS, 4.LONG WITH APPROVED SITE PLAN, WITH AS-BUILT NOTATIONS,
<br />SHALL BE ON SITE AT ALL TIMES.
<br />13.CONTRACTOR 1S RESPONSIBLE FOR ANY PRODUCT IN TANKS AND IN LINES UNTIL LOCATION OPENS OR REOPENS FOR
<br />GASOLINE BUSINESS. ANY PRODUCT LOSS DURING CONSTRUCTION SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR.
<br />PA/QA TO PROJECT ACCEPTANCE, THE OWNER SHALL RECONCILE INVENTORY BY COMPARING PRODUCT IN TANKS AND
<br />LINES TO AMOUNT DELIVERED SHORTAGES SHALL BE BILLED TO CONTRACTOR AT FULL RETAIL PRICE.
<br />14.CONTRACTOR MUST PROVIDE ADEQUATE PROVISIONS TO MITIGATE RA.IN DAMAGE AND DELAYS (I E. PUMPS. TARPS.
<br />ETC.)
<br />15.UPON COMPLETION OF PROJECT, CONTRACTOR SHALL PROVIDE OWNER WITH "AS-BUILT" DRAWINGS OF ALL ITEMS
<br />INSTALLED BY SAME. “AS-BUILT” SHALL BE COMPLETED ON-SITE WITH INFORMATION NOTED DIRECTLY ON APPROVED
<br />JOB COPY.
<br />16.CONTRACTOR TO WARRANTY ALL WORKMANSHIP AND CONTRACTOR SUPPLIED MATERIAL FOR 1 YEAR THE OWNER
<br />SHALL PERFORM A 10 MONTH WARRANTY INSPECTION TO EVALUATE CONTRACTOR PERFORMANCE ANO QUALITY OF
<br />WORKMANSHIP. CONTRACTOR MUST COMPLETE ALL PUNCH LIST ITEMS IDENTIFIED DURING THIS 10 MONTH
<br />INSPECTION.
<br />17.CONTRACTOR SHALL PROVIDE A LIST OF SUB-CONTRACTORS. IF ANY, WHO WILL BE USED ON THE PROJECT, IF REQUIRED.
<br />18.CONTRACTOR IS TO SCHEDULE ALL SUBCONTRACTORS, INCLUDING THOSE CONTRACTED .DIRECTLY WITH THE OWNER'S
<br />CONSTRUCTION MANAGER. THE OWNER WILL PROVIDE A LIST OF SUBCONTRACTORS, CONTACTS AND PHONE NUMBERS
<br />FOR THOSE SUBCONTRACTORS THAT HAVE CONTRACTS DIRECTLY WITH THE OWNER.
<br />19.CONTRACTOR SHALL COORDINATE ALL INSPECTIONS AND APPROVALS AND OBTAIN, AT THE COMPLETION OF THE
<br />PROJECT, ALL CERTIFICATES REQUIRED TO RUN THE FACILITY.
<br />20.CONTRACTOR SHALL PLACE THE HIGHEST PRIORITY ON SAFETY AND HEALTH DURING THE PROGRESS OF WORK
<br />PERFORMED AT THE OWNER'S STORE LOCATIONS. IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO PROVIDE
<br />AND MAINTAIN A SAFE WORKING ENVIRONMENT FOR ITS EMPLOYEES DURING THE PROGRESS OF WORK AND TO
<br />PROTECT THE HEALTH AND SAFETY OF CONTRACTOR'S AGENTS, SUBCONTRACTORS, THE PUBLIC AND ANY THIRD
<br />PARTIES. ALL TOOLS, MATERIALS, EQUIPMENT, FACILITIES AND OTHER ITEMS USED BY THE CONTRACTOR AND PRACTICES
<br />EMPLOYED BY THE CONTRACTOR IN ACCOMPLISHING THE WORK ARE CONSIDERED TO BE PART OF THE WORKING
<br />ENVIRONMENT,
<br />21.CONTRACTOR TO KEEP ON SITE MATERIAL SAFETY DATA SHEETS (MSOS) FOR CHEMICAL COMPOUNDS REGULATED
<br />THROUGH USEPA THAT WILL BE USED ON-SITE OR HAS THE POTENTIAL FOR HUMAN CONTACT (I.E. GASOLINE, DAY ICE,
<br />SOLVENTS.GLUES.ETC)
<br />22.WHILE ON SITE AND DURING WORKING HOURS, CONTRACTOR'S PERSONNEL MUST WEAR SHIRTS, LONG PANTS, HARD
<br />HATS WHEN REQUIRED, AND ACCEPTABLE FOOT WEAR PER OSHA REGULATIONS.
<br />23.CONTRACTOR TO DEVELOP A SPECIFIC SITE SAFETY PLAN FOR TANK AND EQUIPMENT INSTALLATION PRIOR TO THE START
<br />OF WORK, CONTRACTOR WILL CONDUCT WEEKLY JOB SITE SAFETY MEETINGS WITH ITS EMPLOYEES AND THE MEETING
<br />MINUTES WILL BE SUPPLIED TO OWNER.
<br />D: STEEL PIPE: ALL METAL PIPING SHALL BE BLACK IRON SCHEDULE 40, OR EXTRA STRONG GALVANIZED PIPE IS NOT ALLOWED. FITTING SHALL SE
<br />300 PSI MALLEABLE IRON.
<br /> ALL STEEL PIPE BELOW GRADE IS TO BE DOUBLE WRAPPED WITH 20 MIL PVC PIPE WRAP, OVER A PIPE WRAP PRIMER FOR USE WITH VINYL
<br />TAPES, AND SHALL BE BY THE SAME MANUFACTURER AS THE WRAP.
<br />E: ALL THREADED CONNECTIONS SHALL BE THREADED WITH SEALANT WHICH SHALL BE CURRENTLY WARRANTED BY MANUFACTURER FOR FULL
<br />COMPATIBILITY WITH THE PIPING MATERIAL USED, AND FOR USE WITH PETROLEUM SOLVENTS, FUELS, OILS, DIESEL, AND 100 % METHANOL, WHICH
<br />SHALL BE VERIFIED BY CURRENT MANUFACTURER'S PRODUCT DATA SHEET.
<br />F: CONTRACTOR SHALL DEMONSTRATE TO OWNER'S REPRESENTATIVE THAT ALL MATERIALS ARE NEW AND CONFORM TO ABOVE SPECS, IF
<br />REQUIRED.
<br />19.DO NOT PLACE PRODUCT PIPING UNDER BUILDINGS. PIPING RUNS OVER TANKS SHALL BE MINIMIZED. MAINTAIN MINIMUM CLEARANCE AS
<br />REQUIRED BY MANUFACTURER MINIMIZED CROSSING OTHER LINES AND CONDUIT. IF PIPING IS NOT SHOWN ON SITE PLAN, CONTRACTOR
<br />SHALL RUN LINES THE MOST DIRECT ROUTE SUBJECT TO APPROVAL BY OWNER'S REPRESENTATIVE.
<br />20.PROVIDE AND INSTALL CONDUIT & WIRING FOR PETROLEUM SYSTEM(S) AS INDICATED.
<br />21.All CONDUIT IS TO BE ¾” (MINIMUM).
<br />22.INSTALL NEW MONITORING COMPONENTS, AS REQUIRED. PER DRAWINGS AND EQUIPMENT LIST.

<br />24.INSTALL NEW CONCRETE TANK AND DRIVE SLABS AND OTHER FUELING SYSTEM CONCRETE AS INDICATED ON SITE PLAN. CONCRETE SHALL HAVE

<br />DISPENSERS
<br />PURGE THE AIR FROM THE PIPING SYSTEM USING INDUSTRY STANDARD PRACTICES AND A GROUNDED CONTAINER APPROVED FOR STORAGE AND
<br />HANDLING CLASS I FLAMMABLE LIQUIDS.
<br />2.DISPENSERS SHALL BE SECURELY ATTACHED TO ANCHOR BOLTS WHICH SHALL BE SET IN CONCRETE ISLANDS. EXPANSION BOLTS MAY ONLY BE
<br />USED WITH THE WRITTEN APPROVAL OF THE OWNER'S CONSTRUCTION MANAGER. QUANTITY AND SIZE OF ANCHOR BOLTS SHALL BE AS
<br />SPECIFIED IN DISPENSER MANUFACTURER'S INSTALLATION INSTRUCTIONS. THE DISPENSERS ARE TO BE INSTALLED LEVEL AND ARE TO BE
<br />CAULKED WITH A GRAY SILICONE AT ISLAND/DISPENSER INTERFACE.
<br />3.DISPENSERS SHALL BE ACTIVATED ONLY IN PRESENCE OF AN AUTHORIZED DISPENSER REPRESENTATIVE. CONTRACTOR HAS SOLE RESPONSIBILITY
<br />FOR DAMAGE TO DISPENSER(S) IF THIS INSTRUCTION IS NOT FOLLOWED.
<br />4.CONFIRM DISPENSER OPERATIONS (STP ISOLATION, BRAND PANELS, DECALS AND NOZZLES MATCH, ETC.) IF MISCONNECTIONS OR OTHER
<br />PROBLEMS ARE DETECTED DURING CONFIRMATION OF DISPENSER OPERATIONS MAKE CORRECTIONS AND REPEAT DISPENSER CHEACK-OUT
<br />PROCEDURE.
<br />5.CALIBRATE AND SEAL METERS PER LOCAL REGULATIONS. ANY RE-CALIBRATION REQUIRED TO OBTAIN APPROVAL FROM LOCAL REGULATORS
<br />SHALL BE CONTRACTOR'S RESPONSIBILITY.
<br />6.CONTRACTOR TO FURNISH AND INSTALL NEW DISPENSER FILTERS AFTER COMPLETING ALL LIQUID TESTING AND PRODUCT LINE PURGING.
<br />ACTIVATE EACH PRODUCT ON EACH DISPENSER AND INSPECT FILTER FOR LEAKS, RECHECK PRIMARY LINE CONNECTIONS AT DISPENSER BASE
<br />AND STOP FOR LEAKS.
<br />7.CONTRACTOR SHALL PERFORM START-UP IF APPROVED BY THE DISPENSER/POS MANUFACTURER. IF CONTRACTOR IS NOT APPROVED BY THE
<br />DISPENSER/POS MANUFACTURER, THEN AN AUTHORIZED CONTRACTOR SHALL BE SUBCONTRACTED TO PERFORM START-UP. CONTRACTOR
<br />SHALL ALSO PROVIDE AN AUTHORIZED SERVICE TECHNICIAN TO PROVIDE UP TO 8 HOURS OF ON-SITE TRAINING FOR STORE PERSONNEL.
<br />CONTRACTOR IS RESPONSIBLE FOR START-UP AND CALIBRATION OF FUELING SYSTEMS. COST MUST BE INCLUDED IN CONTRACTOR'S BASE BID.
<br />8.CONTRACTOR SHALL PROVIDE AND INSTALL PUMP NUMBERS, OCTANE DECALS. NO SMOKING DECALS AND EMERGENCY SHUT-OFF SIGNS, PER
<br />THE OWNER'S IMAGE GUIDELINES AND ALL APPLICABLE CODES AND REGULATIONS. CONTRACTOR SHALL INSTALL ALL OWNER PROVIDED
<br />DECALS, PUMP TOPPERS AND WINDSHIELD CADDIES/TRASH CANS PRIOR TO FINAL PROJECT ACCEPTANCE.
<br />9.CONTRACTOR TO FURNISH AND INSTALL FIRE EXTINGUISHERS AND APPROPRIATE DECALS PER APPLICABLE REGULATIONS.
<br /> TESTING
<br />1.OWNER'S REPRESENTATIVE SHALL WITNESS ALL TESTING AT HIS/HER DISCRETION. CONTRACTOR SHALL NOTIFY THE OWNER'S REPRESENTATIVE
<br />TWO DAYS PRIOR TO ANY TESTING, IN WRITING.
<br />2.ALL TESTING SHALL COMPLY WITH MANUFACTURER'S INSTRUCTIONS AND REQUIREMENTS, TRADE STANDARDS AND GOVERNING RULES AND
<br />CODES, INCLUDING THE USE OF CERTIFIED AND APPROVED INDEPENDENT THIRD PARTY TESTERS, WHEN REQUIRED.
<br />3.FINAL TESTING SHALL BE CONDUCTED BY A THIRD PARTY TESTING COMPANY SUBCONTRACTED TO THE CONTRACTOR TESTING METHODS MUST
<br />BE APPROVED BY THE OWNER'S CONSTRUCTION MANAGEMENT AND CONFORM TO ALL REGULATIONS AND CODES. CONTRACTOR SHALL

<br />10.PROVIDE LIQUID REMOVAL TEST FOR BALANCE SYSTEMS (GASOLINE) WITH A LIQUID REMOVAL DEVICE REQUIRED BY A CARB EXECUTIVE ORDER,
<br />IF MORE THAN 100 ML OF LIQUID IS FOUND IN THE VAPOR PATH. THIS SHALL BE DETERMINED BY LOWERING THE GASOLINE DISPENSING NOZZLE

<br />INITIALED/SIGNED BY CONTRACTOR AND THE OWNER'S CONSTRUCTION MANAGER AS APPROPRIATE AS EACH STEP IS COMPLETED.
<br />9.AN UNDERGROUND EQUIPMENT INSTALLATION AFFIDAVIT SHALL BE FILLED OUT BY CONTRACTOR AND SUBMITTED TO THE
<br />OWNER'S CONSTRUCTION MANAGER IN BOUND PROJECT CLOSE OUT FOLDER.
<br />10.CONTRACTOR TO PROVIDE TANK TEST MANIFOLDS PER MANUFACTURER'S INSTRUCTIONS AND SPECIFICATIONS. PRESSURE GAUGES
<br />SHALL BE IN GOOD REPAIR AND HAVE A CALIBRATION DATE WITHIN 30 DAYS OF USE. PRESSURE GAUGES DAMAGED OR OUT OF
<br />CALIBRATION WILL NOT BE PERMITTED.
<br />11.THE CONTRACTOR ACCEPTS FULL RESPONSIBILITY FOR PROPER HANDLING AND INSTALLATION OF THE UNDERGROUND STORAGE TANKS AND
<br />SHALL ENSURE THAT GOOD WORKMANSHIP PRACTICES AND CONSTRUCTION PROCEDURES ARE FOLLOWED REGARDLESS OF THE INCLUSION OR
<br />OMISSIONS OF ANY APPLICABLE SUGGESTIONS IN THESE INSTRUCTIONS.
<br />12.UNKNOWN SITUATIONS OR CONDITIONS NOT COVERED IN THESE SPECIFICATIONS AND THE MANUFACTURER'S INSTRUCTIONS ARE THE
<br />RESPONSIBILITY OF THE CONTRACTOR. MANUFACTURER'S SPECIALISTS ARE AVAILABLE FOR CONSULTATION. THE PRESENCE OF THE OWNER'S

<br />13.TANKS SHALL BE PLACED ACCORDING TO THE TANK MANUFACTURER'S INSTALLATION MANUAL AND THE OWNER'S TANK DRAWINGS. PLEASE
<br />NOTE THAT IF THE SOIL IS UNSTABLE. THE STANDARDS MAY BE INCREASED. DISTANCE BETWEEN TANKS SHALL BE GOVERNED BY
<br />MANUFACTURER'S OR STATE AND LOCAL REQUIREMENTS, WHICHEVER IS GREATER.
<br />14.TANKS ARE TO BE SET LEVEL AND BACKFILLED TO TOP OF TANK THE SAME DAY AS TESTING.
