The Prime Contractor agrees further to release retainer payments to each Subcontractor within 30 days after the subcontractor’s work is satisfactorily completed. 1-7 AWARD AND EXECUTION OF CONTRACT 1-7.1 General Add the following to this subsection: The award of the contract, if it is awarded, will be to the lowest responsive, responsible BIDDER whose proposal complies with all requirements described. The award, if made, will be made within 60 working days after the opening of the bids. No proposal shall be considered binding upon the AGENCY until the execution of the contract by the AGENCY. The date of the contract shall be the date the contract is executed by the AGENCY. The AGENCY reserves the right to waive minor irregularities in their consideration of the award of the bid. The award, if made, shall be by mutual consent in writing of the parties signatory to the contract. Alterations or deviations, increases or decreases, additions or omissions, in the plans and specifications may be made and the same shall in no way affect or make void the contract. 1-7.2 Contract Bonds Add the following to this subsection: The bonds shall be executed by the successful BIDDER and returned within ten (10) business days after the successful BIDDER has received notice that the contract has been awarded. Each bond shall incorporate, by reference, the contract and shall be signed by both the BIDDER and Surety.
