A Construction Change Directive shall be used in the absence of total agreement on the terms of <br />a Change Order. <br />C. Upon receipt of a Construction Change Directive, the Contractor shall promptly proceed with <br />the change in the Work involved. As soon as possible, but no longer than seven days of receipt, <br />the Contractor shall advise the Owner and the Architect of the Contractor’s agreement or <br />disagreement with the cost or the method, if any, provided in the Construction Change Directive <br />for determining the proposed adjustment in the Contract Sum or Contract Time. If the <br />Contractor does not timely disagree with the adjustments, the Construction Change Directive <br />will be deemed an agreed “Change Order”. The Contractor’s notice shall reasonably specify the <br />reasons for its disagreement and the amount or other terms that it proposes. Without such timely <br />written notice, the Contractor shall conclusively be deemed to have accepted the Owner’s <br />adjustment. The Contractor’s disagreement shall not relieve the Contractor its obligation to <br />comply promptly with any written notice issued by the Owner or the Architect. The adjustment <br />shall then be determined by the Owner on the basis of reasonable expenditures and savings of <br />those performing the Work attributable to the change, in strict accordance with this Paragraph <br />and other applicable provisions of the Contract Documents. <br />PART 2 - PRODUCTS (NOT USED) <br />PART 3 - EXECUTION (NOT USED) <br />END OF SECTION 012600
