BARBARA CATHOLIC SCHOOL TASK 2 75-24272-01 DIOCESE OF ORANGE SEPTEMBER 12TH, 2024 SANTA ANA, CA BID & PERMIT SET CONTRACT MODIFICATION PROCEDURES 012600 - 3 Work within the general scope of the Contract consisting of additions, deletions or other revisions, the Contract Sum and Contract Time being adjusted accordingly. B. A Construction Change Directive shall be used in the absence of total agreement on the terms of a Change Order. C. Upon receipt of a Construction Change Directive, the Contractor shall promptly proceed with the change in the Work involved. As soon as possible, but no longer than seven days of receipt, the Contractor shall advise the Owner and the Architect of the Contractor’s agreement or disagreement with the cost or the method, if any, provided in the Construction Change Directive for determining the proposed adjustment in the Contract Sum or Contract Time. If the Contractor does not timely disagree with the adjustments, the Construction Change Directive will be deemed an agreed “Change Order”. The Contractor’s notice shall reasonably specify the reasons for its disagreement and the amount or other terms that it proposes. Without such timely written notice, the Contractor shall conclusively be deemed to have accepted the Owner’s adjustment. The Contractor’s disagreement shall not relieve the Contractor its obligation to comply promptly with any written notice issued by the Owner or the Architect. The adjustment shall then be determined by the Owner on the basis of reasonable expenditures and savings of those performing the Work attributable to the change, in strict accordance with this Paragraph and other applicable provisions of the Contract Documents.
