5.10 Promotional Salary Advancement. When an employee is promoted to a <br />position in a higher classification from a position [no lower classification in the <br />same occupational career ladder, he or she shall be reassigned to Step <br />"AA" in the appropriate salary rate range for the higher classification; <br />provided, however, that if the base salary step currently being paid such <br />employee is already equal to or higher than Step "AA," he or she shall be <br />placed in the lowest step in the appropriate salary rate range as will grant <br />that employee a minimum increase of 5% over his or her current base salary <br />step, inclusive of lead pay, and exclusive of any other assignment or special <br />pay additive or additives such as bilingual pay, shift differential, special skill <br />pay or the like, except when placement at "E" step will not be sufficient to <br />provide a 5% increase. <br />5.11 Demotion. When an employee is demoted to a position in a lower <br />classification, his or her salaryrate shall be fixed in the appropriate salaryrate <br />range for the lower classification in accordance vrlth the following provisions: <br />A. The salary rate shall be reduced by at least one (1) salary step <br />(approximately 5%). <br />B. The new salary rate must be within the appropriate salary rate range. <br />C. The new salary rate shall not be higher than the salary step to which <br />the employee would have been entitled had his or her service time in <br />the higher classification been spent in the lower classification. <br />D. If the salary rate recommended by the Department Head is lowerthan <br />the maximum step permissible under Subsection C above, such <br />recommendation shall be considered a reduction in pay in addition to <br />the demotion and shall be handled in accordance with the provisions <br />for salary'reductions in Section 5.9 above. <br />5.12 Reallocation of Salary Rate Ranges. Any employee who is employed in a <br />classification which is reallocated to a different salary rate range from that <br />previously assigned shall be retained in the some salary step in the new <br />salary rate range as he or she had previously held in the prior rate range and <br />shall retain credit for length of service in such step towards advancement to <br />the next higher step. <br />5.13 Request for Classification Review. Any employee who, for a continuous <br />period exceeding six (6) months, believes he or she is regularly and <br />consistently performing duties and/or responsibilities not in conformonce with <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA (CASA) MOU: 2017-2018 Page 16 <br />
