(b) No component of a wireless facility shall extend seven (7) feet beyond <br />the top of a pole. However, no facility located within one -hundred and forty <br />(140) feet of a residential property shall exceed thirty-five (35) feet in <br />height. Additionally, no facility shall exceed sixty (60) feet in height from <br />the ground level as measured from the nearest street curb. The Director <br />may waive these requirements if necessary to accommodate General <br />Order 95 of the California Public Utilities Commission. <br />(c) No facility shall be illuminated unless specifically required by the Federal <br />Aviation Administration or other governmental agency for security or <br />clearance purposes. <br />(d) Signs and Advertising. No advertising signage or identifying logos shall <br />be displayed on any facility except for small identification, address, <br />warnings, and other similar information plates. Such information plates <br />shall be identified in the application and shall be subject to approval by <br />the Director. <br />Sec. 33-246. - Noise. <br />Wireless facilities and all accessory equipment and transmission <br />equipment must comply with all noise regulations pursuant to Article VI of Chapter <br />18 of this Code. <br />Sec. 33-247. - Public Safety Guidelines. <br />(a) Arterial Highway Pedestrian Passage. In public rights-of-way that are <br />designated in the Circulation Element of the City's General Pian as <br />"arterial" streets or highways, and which have an existing sidewalk, the <br />facility should be located on the sidewalk or parkway such that there is a <br />minimum of six feet (6') of unobstructed distance between the edge of <br />the facility and any private property, in order to provide sufficient <br />clearance for pedestrians and wheelchairs. If the paved sidewalk is less <br />than six feet (6') wide, the applicant may propose to construct additional <br />sidewalk to- meet -this requirement; provided, however, that a sufficient <br />length of sidewalk shall be constructed to meet the six-foot (6') standard <br />described in this subsection. The facility shall be installed in the public <br />right-of-way with a minimum of eighteen inches (18") of unobstructed <br />distance maintained between the edge of the facility and the edge of the <br />curb face. <br />(b) Non -Arterial Highway Pedestrian Passage. In public rights-of-way that <br />are not designated in the Circulation Element of the City's General Plan <br />as "arterial" streets or highways, and which have an existing sidewalk, <br />the facility shall be located on the sidewalk or parkway such that there is <br />a minimum four feet (4') unobstructed distance between the edge of the <br />facility and any private property line, in order to provide sufficient <br />clearance for pedestrians and wheelchairs. If the paved sidewalk is less <br />than four feet (4') wide, the applicant may propose to construct additional <br />sidewalk to meet this requirement if possible; provided, however, that a <br />Ordinance No. NS -XXX <br />Page 15 of 21 <br />50A-19 <br />
