The certification of the SEIR is a CEQA Determination by the City Council. <br />The discretionary approval of the MEMU and Elan projects requires separate <br />actions by the appropriate approving bodies. <br />F. On August 21, 2018, the City Council of the City of Santa Ana held a duly <br />noticed public hearing to consider all testimony, written and oral, related to <br />Subsequent Final Environmental Impact Report No. 2018-15 (SCH No. <br />2006031041), General Plan Amendment No. 2018-03, Amendment <br />Application No. 2018-06; and Zoning Ordinance Amendment No. 2018-02 for <br />the Metro East Mixed Use Overlay Zone expansion and amendments project, <br />at which time all persons wishing to testify were heard, the project was fully <br />considered, and all other legal prerequisites to the adoption of this Resolution <br />occurred. <br />G. Pursuant to the California Environmental Quality Act (Pub. Res. Code sec. <br />21000 et seq.; "CEQA"), and the State CEQA Guidelines the City has <br />determined that a Subsequent Environmental Impact Report (SEIR) should <br />be prepared pursuant to CEQA in order to analyze all potential adverse <br />environmental impacts of the proposed project. <br />1. Pursuant to Public Resources Code section 21067 and the State CEQA <br />Guidelines (Cal. Code Reg., tit. 14 Sec 15000 et seq.) section 15051, the <br />City is the lead agency for the proposed Project. <br />2. In accordance with CEQA, the recommended actions have been reviewed <br />through an SEIR. Sections 15080 through 15097, and 15162 of the State <br />CEQA Guidelines (Article 7) guide the process for the preparation of an <br />EIR and an SEIR. <br />3. The California Environmental Quality Act (CEQA) requires that, where <br />there is the potential for environmental impacts as the result of a proposed <br />project, an EIR be prepared in order to study and analyze any potential <br />environmental impacts, disclose such potential impacts to the public, and <br />mitigate such impacts to the greatest extent feasible. As such, an EIR <br />was prepared for the original MEMU Overlay Zone in 2007 and was <br />subsequently certified by the City Council. <br />Resolution No. 2018-075 <br />Page 2 of 12 <br />
