8. The City received a total of nine (9) written comment letters and two (2) <br />verbal comments during the public review period and evaluated all <br />comments received from the persons or agencies that reviewed the draft <br />SEIR. Pursuant to Section 15088 of the State CEQA Guidelines, the City, <br />as the lead agency for the project, has reviewed all comments received on <br />the document. The City provided written responses to all agencies and <br />members of the public commenting on the draft SEIR at least 10 days <br />prior to the City Council hearing. <br />9. In accordance with Senate Bill 18 (SB 18) and Government Code Section <br />69352.3, and Assembly Bill 52 (AB 52) and Government Code 21000, the <br />City of Santa Ana requested a list of Tribal Organization contacts from the <br />Native American Heritage Commission and sent notifications to the <br />appropriate tribal organizations in January 2018 in compliance with SB 18, <br />and again in April 2018 to comply with AB 52. No tribes requested <br />consultation for the proposed project, and no tribal cultural resources were <br />identified in the proposed project area. As a result, no new mitigation <br />measures addressing cultural resources, including tribal cultural <br />resources, were required. <br />10.The City has prepared a Final SEIR, consisting of comments and <br />recommendations received during the 45 -day public review and comment <br />period, written responses to those comments, and revisions and <br />clarifications to the draft SEIR in response to those comments. For the <br />purposes of this Resolution, the SEIR shall refer to the draft SEIR, <br />including all of the technical studies and appendices to the draft SEIR, as <br />revised by the Final SEIR's revisions, together with the other sections of <br />the Final SEIR, including all of the technical studies, attachments, and <br />appendices to the Final SEIR. <br />11. Findings of Fact with respect to environmental impacts, including <br />environmental impacts identified in the Final SEIR as potentially <br />significant, but which the City finds can be substantially lessened through <br />the imposition of feasible mitigation measures identified in the Final SIER, <br />are described in Exhibit A attached hereto and incorporated herein by this <br />reference. As a result of the environmental analysis in the SEIR, one <br />significant impact was found from the construction of the proposed Elan <br />project that pertains to loss of an eligible historic resource. Accordingly, <br />the City has also prepared a Statement of Overriding Considerations in <br />compliance with Public Resources Code Sections 21081 and CEQA <br />Guidelines Section 15093, which finds that specific economic, legal, <br />social, technological, or other benefits of the proposed project outweigh <br />the significant and unavoidable impacts identified in the EIR. This <br />Statement of Overriding Considerations is also described in Exhibit A <br />attached hereto and incorporated herein by this reference. <br />Resolution No. 2018-075 <br />Page 4 of 12 <br />
