City of Santa Ana <br />SECTION 3 <br />GENERAL TERMS AND CONDITIONS <br />3.1 PROPOSED CONTRACT <br />The proposed Contract is attached to this RFP as Attachment No. 1. Please <br />review the terms of the proposed Contract carefully (the "Contract' or the "Agreement'). <br />Where there is a discrepancy in the terms of this RFP and the terms of the Contract, the <br />terms of the Contract shall prevail. <br />3.2 CONTRACT DOCUMENTS <br />The Contract entered into by the successful Proposer shall consist of the: <br />3.2.1 Executed Contract <br />Executed Contract between the City of Santa Ana and Contractor <br />attached as Attachment No. 1 to this RFP. <br />3.2.2 RFP <br />Request for Proposal(s) <br />3.2.3 Original Bid Proposal(s) <br />Signed, original bid proposal(s) submitted by the successful Proposer <br />('Bid Proposal') <br />The Executed Contract, the RFP, and the Bid Proposal(s), submitted by the successful <br />Proposer will be incorporated and made a part of the Contract and shall be hereinafter <br />collectively referred to as the "Contract Documents." All provisions of the RFP, the Bid <br />Proposal(s), and the contract shall be binding on the parties.
