LS 2.5.19 <br />RESOLUTION NO. 2019 -XX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DENYING A REQUEST TO CERTIFY FINAL <br />ENVIRONMENTAL IMPACT REPORT NO. 2018-01 (SCH <br />#2018021031), AND DENYING A REQUEST FOR APPROVAL OF <br />AMENDMENT APPLICATION NO. 2018-10, DEVELOPMENT <br />AGREEMENT NO. 2018-01, AND GENERAL PLAN AMENDMENT <br />NO. 2018-06 FOR THE PROPOSED MULTI -FAMILY <br />RESIDENTIAL PROJECT LOCATED WITHIN THE CITY OF <br />SANTA ANA AT 2525 NORTH MAIN STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />WHEREAS, Jeremy Ogulnick, representing AC 2525 Main LLC <br />("Applicant'), is requesting that the City Council certify Final EIR No. 2018-01 and <br />adopt the findings of fact, statement of overriding considerations, and the <br />Mitigation Monitoring and Reporting Program for the proposed project. Further, <br />the applicant is requesting approval of Development Agreement No. 2018-01, <br />General Plan Amendment No. 2018-06, and Amendment Application No. 2018- <br />10 to allow the construction of a 476 -unit multi -family apartment project at the <br />property located at 2525 North Main Street. <br />WHEREAS, the site contains a two-story, 81,000 square foot office building <br />that has been vacant for several years. The Applicant proposes to redevelop the <br />site with a residential use. <br />WHEREAS, on January 14, 2019, the Planning Commission of the City of <br />Santa Ana held a duly noticed public hearing and at that time considered all <br />testimony, written and oral, and recommended that the City Council deny the <br />certification of Final EIR No. 2018-01 and deny the findings of fact, statement of <br />overriding considerations, and the Mitigation Monitoring and Reporting Program; <br />and recommended that the Council deny Development Agreement No. 2018-01, <br />General Plan Amendment No. 2018-06, and Amendment Application No. 2018- <br />10. <br />WHEREAS, on January 14, 2019, a total of 79 members of the public <br />spoke on the matter, with 30 in support of the project, 48 against the project, and <br />one (1) neutral on the project. <br />WHEREAS, the overwhelmingly majority of speakers in opposition of the <br />project resides within the Park Santiago Community. <br />Resolution No. 2019-xx <br />Page 1 of 4 <br />Exhibit 1 <br />75E-25 <br />
