WHEREAS, the Planning Commission determined that the project has not <br />adequately addressed community concerns from the adjacent residents and <br />residential neighborhood on which the project will have the most immediate and <br />direct contact and impacts associated with the physical design of the proposed <br />development, the significant and unavoidable aesthetics impact and change to <br />the existing environment, the increase in traffic volumes and reduced traffic flow, <br />and the potential parking and traffic intrusion into the adjacent neighborhood. <br />WHEREAS, after deliberating on the matter, the Planning Commission <br />voted to recommend that the City Council deny the Applicant's request to allow <br />the multi -family residential development on the site. <br />WHEREAS, the City Council of the City of Santa Ana agrees with the <br />Planning Commission recommendation of denial and determines that all of the <br />findings required for certifying Final EIR No. 2018-01 and the findings of fact, <br />statement of overriding considerations, and the Mitigation Monitoring and <br />Reporting Program for the proposed project could not be made. Further, the City <br />Council of the City of Santa Ana agrees with the Planning Commission <br />recommendation to deny the project and the determination that all of the findings <br />required for approval of Development Agreement No. 2018-01, General Plan <br />Amendment No. 2018-06, and Amendment Application No. 2018-10 could not be <br />made. The City Council does hereby find and determine that the following finding <br />has been established for the project: <br />1. That the proposed use will under the circumstances of <br />the particular case, not be a good planning practice and it will be <br />detrimental to the health, safety, and general welfare of persons <br />residing and working in the vicinity in that it will negatively increase <br />traffic volume . and further degrade the traffic flow on the <br />surrounding streets and intersections and would result in additional <br />delays and cut through traffic to the Park Santiago Neighborhood; it <br />will create a significant and unavoidable aesthetic impact to the <br />existing environment and physical surrounding that cannot be <br />mitigated resulting from the massing and the height of the <br />residential and parking structures. The residential units and <br />parking structure ranges from 2 to 8 stories in height. Even with <br />mitigations, the aesthetics of the height and the massing of the <br />structures were found to be incompatible with the adjacent one to <br />two-story single family homes to the east and south of the project <br />site within the Park Santiago neighborhood; and at 81 dwelling <br />units per acre, the proposed project will create a significantly higher <br />residential density and development intensity and is incompatible <br />with the density of the residential developments to the east and <br />south currently developed at 7 dwelling units per acre within the <br />Park Santiago neighborhood. <br />WHEREAS, the City Council, after due notice as required by law, <br />conducted a full and fair public hearing to consider Final EIR No. 2018-01, <br />Resolution No. 2019-xx <br />Page 2 of 4 <br />75E-26 <br />
