The final EIR should include a reference that Park Santiago neighborhood is in <br />the project vicinity and immediately adjacent to the project in the Environmental Setting section. <br />Additionally, a statement is made that "the assessment of aesthetic impacts is subjective by nature." <br />Thus, the authors of the EIR must not be the ultimate arbiters of what is and is not an adverse aesthetic <br />impact of the project. Rather, the opinions and observations of the residents of Park Santiago, who will be <br />daily impacted by any changes to the immediate environmental setting, must be given the greatest weight <br />and consideration. The final EIR should address Park Santiago residents' opinions of the aesthetic <br />impact. <br />4.1.4 Environmental Impacts. Viewpoint D – Simulated view <br />The representation of the westward view from Spurgeon Street is extremely misleading, as it not only <br />minimizes the scale of the tiered five -story elevations, it includes a very mature, densely packed tree line <br />as a screen purporting to protect the privacy of the existing single-family homes from intrusion by the <br />imposing Magnolia buildings. In fact, it would likely take a decade or more for the trees to reach the height <br />and density as shown in the conceptualized Viewpoint D, and the EIR indicates eight existing trees must <br />be removed and replaced. Even when the trees eventually reach maturity, residents of Spurgeon Street <br />and Virginia Avenue will nonetheless forever lose their privacy, as the five -story buildings—particularly <br />those located at the north-eastern edge of the project—will still have full view into the backyards and <br />homes. Balconies and patios are a feature of all Magnolia units and will contribute to the loss of privacy. <br />The final EIR should include more realistic simulated views of the project immediately following <br />completion and estimated timeframes for landscape growth, and consider the impact from patios and <br />balconies.
