iI <br />February 19, 2019 <br />To: The Mayor & City Council Members <br />City of Santa Ana. <br />Re: 19D APPROVE THE REQUEST FOR PROPOSALS FOR THE <br />SALE OF CITY -OWNED PROPERTIES WITH RESTRICTED USE <br />OF PROCEEDS AND ALLOW FOR DIRECT NEGOTIATION FOR SALE <br />OF EXEMPT REAL PROPERTY PER SANTA ANA MUNICIPAL CODE <br />{STRATEGIC PLAN NOS, 3, 2C, gA & 6, 1G} <br />Dear Mayor Pulido and Santa Ana City Council Members: <br />We are writing this letter to ask you to continue the item 19D, the Request <br />for Proposals for the sale of City -Owned real properties, until you as a <br />policy making body can answer in writing, how you are complying with the <br />CA Surplus Land Act with the proposal of these sales. <br />In particular, we ask that the City Council (1) clarify its position on <br />compliance with the Act; and (2) take all necessary steps to ensure that it <br />fully complies with the Surplus Land Act, including following the Act's <br />requirements in the sale or lease of all surplus City -Owned real property. <br />By authorizing the City to approve the Request for Proposal for the Sale of <br />City -Owned real properties with restricted use of proceeds and allow for <br />direct negotiation for sale of exempt real property, we believe is in conflict <br />with the Surplus Land Act's requirements and provisions relating to <br />notification and the prioritization of affordable housing. <br />In addition, the City of Santa Ana is undertaking a General Plan Update. <br />The General Plan has not been updated for over 30 years. As stated in your <br />December 4, 2018 staff report, "The goal of the Land Use Element is to <br />provide a long-range guide for the land use and physical development in <br />the City to reflect the community's vision for a quality of life. This element <br />is a tool to promote public health, reduce infrastructure costs and address <br />long-term environmental issues such as climate change and water <br />resources." Given that Land Use will be one of the elements of the General <br />Plan, the sale of these City -Owned real properties is premature and not in <br />line with the City's intent to best promote the goal of the Land Use <br />Element. <br />
