8.9 Compensation for Overtime: Overtime pay or comp time shall be allowed an employee <br />for attendance at conventions, conferences, seminars or the like, as long as prior <br />authorization is received. Overtime pay or comp time pay shall be permitted only for <br />attendance which is ordered on such employee's normal days off or for time beyond a <br />normal workday's duration. Please refer to Santa Ana Police Department Training <br />Bulletin 02-07 for details. <br />8.10 Call -Back -Duty. <br />A. Employees who are on call during their off-duty time due to their assignment (i.e., <br />Homicide Investigators, Internal Affairs Sergeants, Crimes Against Persons <br />Sergeants, etc.) and are called back to work will be paid for their travel time at the <br />overtime rate from the time they leave their home until the time they return home, <br />or until their regularly scheduled shift begins. Only that period of time devoted to <br />work will be compensated. If employees are not home when they are called back <br />to duty, they will receive their normal home to work travel time or if closer to <br />City than their home, travel to that location and back. <br />B. Employees who are ordered back to work while off-duty because of an emergency <br />or other unforeseen event will be paid for travel time at the overtime rate from the <br />time they leave their home until they return home, or until their regularly <br />scheduled shift begins. Only that period of time devoted to work will be <br />compensated. <br />C. Employees who are called at home and offered voluntary overtime work, and <br />elect to accept the offer, will not be compensated for travel time in any manner. <br />Similarly, employees who sign up for voluntary overtime, or who have advance <br />notice that they will have to work during their off-duty time on an overtime basis, <br />will not be compensated for travel time. <br />8.11 Accrued Compensatory Time Off Paid Upon Promotions or Upon Separation. Upon an <br />employee's appointment to a position in which overtime may not be earned or upon an <br />employee's separation from employment with the City by resignation, retirement, layoff <br />or otherwise, he or she shall forthwith be compensated for any overtime accumulated to <br />the time immediately preceding such promotion or separation. <br />8.12 Court Appearance. Compensation for court appearance by personnel covered by this <br />MOU shall be as follows: <br />A. For each required court appearance made by an employee during his or her off- <br />duty time in regard to City business, employees shall be paid overtime for the <br />period of time from their arrival at court until they are released from court or the <br />court session closes for that day. However, in no case, shall an employee receive <br />less than two (2) hours overtime for a court appearance. If court appearances are <br />made both in the morning and afternoon of a particular day, two (2) hours <br />overtime will be allowed for each session attended.
