P. Employees who appear in court during off-duty hours may elect to start their <br />normal work shift early as specified herein. <br />G. A subpoenaed employee scheduled to appear in court on City business during off- <br />duty time and placed on standby status by the Police Chief or his authorized <br />representative will be compensated two (2) hours on a straight time basis if he or <br />she is not advised of the cancellation of his or her appearance within five (5) <br />Court business days of said appearance. <br />8.13 Creation of Association Comp Time Bank. <br />A. Any member of the Association who works overtime, or has accrued but unused <br />holidays, can designate that he or she will contribute the value of such time to a <br />bank for use by members of the Association for the purposes and subject to the <br />restrictions provided herein. <br />B. Any member of the Association may receive time off for the welfare of officers, <br />community service and any lawful activity of the Association with pay drawn <br />from the bank described in Subsection A of this Section, provided that said <br />employee first gains approval for said use by the executive board of the <br />Association in the manner specified by its rules as adopted ;from time to time, and <br />subject to the approval or disapproval of the Police Chief consistent with the <br />operational needs of the Police Department. <br />C. No withdrawal or use of such bank may be made by or on behalf of an employee <br />ordered to take time off without pay for discipline imposed by the Police Chief or <br />his designee. <br />D. The City agrees to provide the SAPOA with a quarterly accounting (at the end of <br />March, June, September and December) of all Association Comp Time accrued <br />and used. <br />8.14 Compensation of Voluntary Contract Overtime. Exclusive of other provisions of this <br />Article, except Section 8.7 (No Effect on Other Benefits) , Police Officers and Police <br />Sergeants who voluntarily agree to perform contract security services at games, parades, <br />dances and similar public events shall be compensated at the rate of one and one-half (1 <br />112) times the employee's regular rate of pay. However, the hours worked do not <br />constitute hours worked under the FLSA. <br />The Police Chief shall determine how many off-duty police officers should serve as <br />security officers at each event. Police Officers and Sergeants represented by the <br />Association shall be given first opportunity to volunteer for such off-duty assignments. If, <br />after a reasonable period of time, an insufficient number of police officers have <br />volunteered to work such assignments, the Police Chief may offer the remaining <br />"openings" to any person(s) he deems capable of performing the work at whatever <br />straight -time pay rate the City considers to be appropriate. <br />32 <br />
