OCTAP Cooperative Agreement & Resolution <br />May 7, 2019 <br />Page 2 <br />shortfall in funding for OCTAP administration. Subsequently, all OCTAP member agencies have <br />been invoiced on a population -based cost sharing formula to cover this funding gap and continue <br />the operation of OCTAP. <br />With Governor Brown's signing of taxi regulation legislation AB 1069 (Chapter 753, Statutes of <br />2017) in October 2017, OCTAP, as it currently exists, could not continue past 2018. Following <br />further discussions between OCTA, OCCMA, and OCTAP stakeholders, all OCTAP member <br />agencies unanimously agreed to request that OCTA continue to administer OCTAP beginning <br />January 1, 2019, for an initial term of two years (term may be extended upon agreement among <br />the parties). Estimated costs for all participating agencies were also agreed upon using the same <br />population -based cost sharing model (provided in Exhibit 2). <br />OCTA staff has prepared a cooperative agreement (Exhibit 3) and is requesting its execution <br />from member agencies. Upon approval, OCCMA and the City will work with OCTA to take steps <br />necessary to continue to administer OCTAP. In the coming months, OCTA will work with member <br />agencies and the taxi industry on what a newly structured OCTAP will look like, including <br />attempting to level the playing field with TNCs and reduce outside costs to support OCTAP. <br />Staff seeks City Council approval for the City Manager to execute Cooperative Agreement No. C- <br />8-2015 with OCTA for a term of two years and adoption of the resolution (Exhibit 1) to reflect new <br />OCTAP regulations. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal #3 — Economic Development, <br />Objective #1 (Implement a comprehensive Economic Development Strategy to Ensure that Santa <br />Ana is a City with a Vibrant Business Climate that is Accessible, User -Friendly, and Welcoming to <br />All Residents and Visitors). <br />FISCAL IMPACT <br />Due to the prevalence of TNCs and the consequent decrease in revenue from reduced permit <br />issuance, OCTAP costs to member agencies have increased. <br />Based on its population, Santa Ana has a 10.08% funding share of the total cost for OCTA to <br />administer the OCTAP program. However, as shown in Attachment A, estimated costs to the City <br />are $9,920 in FY 18/19 (January -June), $23,880 in FY 19/20 (July -June), and $17,751 in FY <br />20/21 (July -December). Funds for the FY 18/19 contribution of $9,920 are available in the <br />General Non -Departmental contract services account (no. 01105015-62300). The share is based <br />on population and the costs are estimated and may be adjusted slightly. <br />55A-2 <br />
