WMI M <br />EXHIBIT B — OUTLINE SPECIFICATIONS <br />DIVISION 1 <br />5. In addition to any other remedies it may have, In the event the Lessor fails to diligently <br />pursue abatement of hazard from ACM, as required under the provisions of this lease, <br />the State may, by notice in writing, terminate this lease. Lessor shall be liable to the <br />State for all expenses, losses and damages reasonably Incurred by the State as a <br />result of such termination, including (but not limited to) additional rental necessary to <br />pay for an available, similar replacement facility. This rental shall extend over the <br />period of what would have been the remaining balance of the lease term plus any <br />option periods, costs or any necessary alterations to the replacement facility, <br />administrative costs, and costs of moving furniture, data processing, and telephone <br />equipment. <br />C. Lead material: <br />1. Any material suspected of containing lead within the areas listed in Paragraph "A" shall <br />be tested and identified through sampling by an independent California Department of <br />Public Health (CDPH) Certified Lead -Related Construction Inspector/Assessor. <br />2. In the event lead removal Is required, Lessor shall provide an independent CDPH <br />Certified Lead -Related Construction Inspector/Assessor to inspect the quality of work <br />for compliance with applicable regulations; perform air monitoring; perform a final <br />clearance visual inspection; conduct wet wipe sampling/lab analysis; and ensure <br />proper handling and/or disposal of hazardous waste. <br />p t.. <br />1. The Lessor shall operate and maintain the leased premises to be free of hazard from <br />mold. <br />2. If mold is detected within the State -leased space, an immediate response action in <br />accordance with industry standard practices shall be undertaken by the Lessor. The <br />Lessor shall contract for the services of an independent CaIOSHA/Certified Industrial <br />Hygienist to determine the appropriate response action. <br />3. Lessor shall be responsible for all costs associated with any hazard response action. <br />E. Underground Storage Tanks (UST): <br />1.
