In case of conflicts between "Exhibit A" and Exhibit "B," the Exhibit <br />"A" supersedes these specifications. <br />D. Lessor shall patch, repair and refinish to match, all existing surfaces disturbed by the new <br />construction. Upon completion of the project, there shall be no visual difference between <br />the new work and the existing conditions. No changes, modifications, or substitutions <br />shall be made to the premises as shown, except with the prior written approval of DGS. <br />E. LEED Certification <br />1. When the lease contract requires LEED (Leadership in Energy and Environmental <br />Design) certification the Lessor shall refer to the following requirements: <br />a) The Lessor shall assign the DGS planner as a team member on the LEED-Online <br />workspace. <br />b) Ina newly constructed building of 10,000 square feet (sf) or greater, the Lessor <br />shall obtain Silver -level LEED certification or better from the U.S. Green Building <br />Council (USGBC) within 12 months of project occupancy. <br />1) For requirements to achieve Silver certification, Lessor must refer to the latest <br />version of LEED at http://www.usgbc.org. At completion of LEED <br />documentation and receipt of final certification, the Lessor must provide DGS <br />an electronic copy on a compact disc. of all documentation submitted to <br />USGBC. Acceptable file format is Adobe PDF saved to disc from the LEED- <br />Online workspace and templates. In addition a DGS or tenant representative <br />shall have access to the LEED-Online workspace during design and through <br />the term of the lease. <br />2) Prior to the end of the first year of occupancy, if the Lessor fails to achieve <br />LEED Silver certification, the State may assist the Lessor in implementing a <br />corrective action program to achieve a LEED Silver certification and deduct its <br />costs (including administrative costs) from the rent. <br />c) In tenant improvements of 10,000 sf or greater, the Lessor shall obtain Silver -level <br />certification or better from USGBC within 12 months of project occupancy. The <br />DGS planner shall be consulted during the point selection process, and selection <br />of which points to obtain shall be decided by mutual agreement. Points related to <br />indoor air quality and lighting are a priority to the State. <br />1) For requirements to achieve certification, Lessor must refer to latest version of <br />the LEED Reference Guide at: http://www.usobc.orp. At completion of LEED <br />documentation and receipt of final certification, the Lessor must provide DGS <br />an electronic copy on a compact disc of all documentation submitted to <br />USGBC.
