Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) INITIAL STUDY <br /> <br />5. INITIAL STUDY <br />5.01 P REPARATION OF I NITIAL S TUDY. <br />If the City determines that it is the Lead Agency for a project which is not exempt, the <br />City will normally prepare an Initial Study to ascertain whether the project may have a <br />substantial adverse effect on the environment, regardless of whether the overall effect of the <br />project is adverse or beneficial. All phases of project planning, implementation and operation <br />must be considered in the Initial Study. An Initial Study may rely on expert opinion supported <br />by facts, technical studies or other substantial evidence. However, an Initial Study is neither <br />intended nor required to include the level of detail included in an EIR. <br />The City, as Lead Agency, may use any of the following arrangements or combination of <br />arrangements to prepare an Initial Study: <br />(1) Preparing the Initial Study directly with the City <br />(2) Contracting with another entity, public or private, to prepare the Initial Study. <br />(3) Accepting a draft Initial Study prepared by the applicant, a consultant retained by <br />the applicant, or any other third person. <br />(4) Executing a third party contract or memorandum of understanding with the <br />applicant to govern the preparation of an Initial Study by an independent contractor. <br />(5) Using a previously prepared Initial Study. <br />The Initial Study sent out for public review, however, must reflect the independent <br />judgment of the Lead Agency. <br />For private projects, the person or entity proposing to carry out the project shall complete <br />Form I of these Local CEQA Guidelines, submit Form I to the City, and submit all other <br />data and information as may be required by the City to determine whether the proposed project <br />may have a significant effect on the environment. All costs incurred by the City in reviewing the <br />data and information submitted, or in conducting its own investigation based upon such data and <br />information, or in preparing an Initial Study for the project shall be borne by the person or entity <br />proposing to carry out the project. <br />5.02 I NFORMAL C ONSULTATION WITH O THER A GENCIES. <br />When more than one public agency will be involved in undertaking or approving a <br />project, the Lead Agency shall consult with all Responsible and any Trustee Agencies. Such <br />consultation shall be undertaken in compliance with the notice procedures applicable to the type <br />of CEQA document being prepared. See Section 6.04, Negative Declarations, and Sections 7.03 <br />and 7.25, EIRs. <br />When the City is acting as Lead Agency, the City may choose to engage in early <br />consultation with Responsible and Trustee Agencies before the City begins to prepare the Initial <br /> <br />2019 City of Santa Ana Local Guidelines 5-1 ©Best Best & Krieger LLP <br /> <br />
