0 <br />CITY COUNCIL MEETING DATE: <br />CLERK OF COUNCIL USE ONLY: <br />JULY 2, 2019 <br />TITLE: APPROVED <br />❑ As Recommended <br />APPROVE AGREEMENT TO APPOINT El [I <br />DAISY GOMEZ AS CLERK OF THE [IOOrrdinance on 13f Reading <br />❑ Ordinance on 2"e Reading <br />COUNCIL EFFECTIVE JULY 16, 2019 ❑ Implementing Resolution <br />(STRATEGIC PLAN NO. 7) ❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />CITY MANAGER <br />Approve an employment agreement outlining the terms and conditions of the appointment of Daisy <br />Gomez as the Clerk of the Council for the City of Santa Ana. <br />DISCUSSION <br />City Charter Section 701 authorizes the City Council to appoint a Clerk of the Council. The Clerk <br />of the Council is responsible for preparing City Council documents, postings and agendas, <br />providing information and maintaining official City records, conducting municipal elections, and <br />ensuring compliance with the Brown Act and Political Reform Act in accordance with all applicable <br />federal, state and local laws. <br />Following a recruitment to identify, interview and evaluate candidates, the City Council selected <br />and desires to appoint Daisy Gomez to the position of Clerk of the Council. The proposed <br />Employment Agreement (Exhibit 1) delineates the terms and conditions of the proposed <br />appointment of Ms. Gomez. This Agreement includes the following primary provisions: <br />• Term: This Agreement shall be deemed effective for a term beginning on July 16, 2019 and <br />shall remain in effect unless terminated earlier in accordance with the provisions of this <br />Agreement. <br />Compensation: City agrees to pay Clerk of the Council a base salary commencing on the <br />effective date set at Step 14 of EM-33, currently at $14,075, and payable in installments <br />made in the same manner and at the same times as the salaries of other executive <br />managers of the City. <br />Benefits: Except as expressly provided for in this Agreement (sick leave, vacation, car <br />allowance, 457 deferred compensation), Clerk of the Council shall be entitled to receive the <br />same benefits provided to other Executive Management employees pursuant to Resolution <br />No. 2015-026, as may be amended from time to time by the City Council. These benefits <br />include, but are not limited to: health insurance (medical, dental, vision), holidays, retiree <br />health savings plan, group life and disabilit insurance, and bereavement leave <br />256-1 <br />
