The City Attorney should review this document PRIOR to it being presented to the Planning <br />Commission. It is poorly written and does not protect the City or the residents that will be <br />impacted. <br />2. WHEREAS. “WHEREAS” should be added to state the Project Site is located within the <br />boundaries of the Park Santiago neighborhood. <br />3. WHEREAS. I disagree with most of these RECITALS. I don’t believe it is in the best the best <br />interests of the citizens of the City of Santa Ana. <br />3.1. to realize significant economic, recreational, park, open space, educational, social and <br />public facilities benefits <br />3.2. will enable the CITY to fund much needed capital improvements and provide much needed <br />public services and will therefore also have a major, beneficial economic impact on the City; <br />and <br />3.3. Agreement and the Project are consistent with the Santa Ana General Plan and any specific <br />plan applicable thereto; and <br />3.4. development of the Property in accordance with this Agreement will provide substantial <br />benefits to CITY and will further important policies and goals of CITY; <br />3.5. the best interests of the citizens of the City of Santa Ana and the public health, safety and <br />welfare will be served by entering into this Agreement; and <br />4. GENERAL PROVISIONS. <br />4.1. [2.4] Term of Agreement is listed as four years. It should be 55 years. <br />4.2. [2.7] Termination. This Agreement shall be deemed terminated and of no further effect <br />upon the occurrence of any of the following events: <br />(a) Expiration of the stated Term of this Agreement as set forth in Section 2.4 <br />(which is the term of four (4) years).
