Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ENVIRONMENTAL IMPACT REPORT <br /> <br /> <br />2019 City of Santa Ana Local Guidelines 7-16 ©Best Best & Krieger LLP <br />transportation plan, or a plan for the reduction of greenhouse gas emissions. A <br />summary of projections may also be contained in an adopted or certified prior <br />environmental document for such a plan. Such projections may be supplemented <br />with additional information such as a regional modeling program. Documents used <br />in creating a summary of projections must be referenced and made available to the <br />public. <br />When utilizing a list, as suggested above, factors to consider when determining whether to <br />include a related project should include the nature of each environmental resource being examined <br />and the location and type of project. Location may be important, for example, when water quality <br />impacts are involved since projects outside the watershed would probably not contribute to a <br />cumulative effect. Project type may be important, for example, when the impact is specialized, <br />such as a particular air pollutant or mode of traffic. <br />Public Resources Code section 21094 also states that if a Lead Agency determines that a <br />cumulative effect has been adequately addressed in an earlier EIR, it need not be examined in a <br />later EIR if the later project’s incremental contribution to the cumulative effect is not cumulatively <br />considerable. A cumulative effect has been adequately addressed in the prior EIR if: <br />(1) it has been mitigated or avoided as a result of the prior EIR; or <br />(2) the cumulative effect has been examined in a sufficient level of detail to enable the <br />effect to be mitigated or avoided by site-specific revisions, the imposition of <br />conditions, or other means in connection with the approval of the later project. <br />Public Resources Code section 21094 only applies to earlier projects that (1) are consistent <br />with the program, plan, policy, or ordinance for which an environmental impact report has been <br />prepared and certified, (2) are consistent with applicable local land use plans and zoning of the <br />city, county, or city and county in which the later project would be located and (3) are not subject <br />to Public Resources Code section 21166. <br />If the Lead Agency determines that the cumulative effect has been adequately addressed in <br />a prior EIR, the Lead Agency should clearly explain the basis for its determination in the current <br />environmental documentation for the project. <br />The City should define the geographic scope of the area affected by the cumulative effect <br />and provide a reasonable explanation for the geographic limitation used. <br />7.22 ANALYSIS OF MITIGATION MEASURES. <br />The discussion of mitigation measures in an EIR must distinguish between measures <br />proposed by project proponents and other measures proposed by Lead, Responsible or Trustee <br />Agencies. This discussion shall identify mitigation measures for each significant environmental <br />effect identified in the EIR. <br />Where several measures are available to mitigate an impact, each should be disclosed and <br />the basis for selecting a particular measure should be identified.
