Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ENVIRONMENTAL IMPACT REPORT <br /> <br /> <br />2019 City of Santa Ana Local Guidelines 7-22 ©Best Best & Krieger LLP <br />(4) For a subdivision project located within one mile of a facility of the State Water <br />Resources Development System, the California Department of Water Resources; <br />and <br />(5) For a general plan amendment, a project of statewide, regional, or area-wide <br />significance, or a project that relates to a public use airport, to any “military service” <br />(defined in Section 11.42 of these Local Guidelines) that has provided the City with <br />its contact office and address and notified the City of the specific boundaries of a <br />“low-level flight path” (defined in Section 11.37 of these Local Guidelines), <br />“military impact zone” (defined in Section 11.41 of these Local Guidelines), or <br />“special use airspace” (defined in Section 11.67of these Local Guidelines; <br />(c) The last known name and address of all organizations and individuals who have previously <br />filed a written request with the City to receive these Notices; <br />(d) For certain projects that may impact a low-level flight path, military impact zone, or special <br />use airspace and that meet the other criteria of Local Guidelines Section 7.04, the specified <br />military services contact; <br />(e) For certain projects that involve the construction or alteration of a facility anticipated to <br />emit hazardous air emissions or handle hazardous substances within one-quarter mile of a <br />school and that meet the other requirements of Local Guidelines Section 7.36, any <br />potentially affected school district; <br />(f) For certain waste-burning projects that meet the requirements of Local Guidelines Section <br />5.11 (see also Local Guidelines Section 7.27), the owners and occupants of property within <br />one-fourth mile of any parcel on which the project will be located; and <br />(g) For a project that establishes or amends a redevelopment plan that contains land in <br />agricultural use, notice and a copy of the Draft EIR shall be provided to the agricultural <br />and farm agencies and organizations specified in Health and Safety Code Section 33333.3. <br />The City requires requests for copies of these Notices to be in writing and to be renewed <br />annually; moreover, the City may charge a fee for the reasonable cost of providing these Notices. <br />A project will not be invalidated due to a failure to send a requested Notice provided there has <br />been substantial compliance with these notice provisions. <br />Staff may also consult with and obtain comments from any person known to have special <br />expertise or any other person or organization whose comments relative to the Draft EIR would be <br />desirable. <br />In addition, notice shall be given to the public by at least one of the following procedures: <br />(a) Publication of the Notice of Completion and/or the Notice of Availability at least once in <br />a newspaper of general circulation in the area affected by the proposed project. If more <br />than one area will be affected, the notice shall be published in the newspaper of largest <br />circulation from among the newspapers of general circulation in those areas; <br />(b) Posting of the Notice of Completion and/or the Notice of Availability on and off site in the <br />area where the project is to be located; or <br />3 -118
