The building was last <br />occupied by Antojitos Don Chepe restaurant and has been vacant since 2016. In November <br />2017, the Planning Division received this development application request and has been working <br />with the applicant to refine the site plan and building design. <br />In accordance with the Sunshine Ordinance, the applicant held two community meetings on <br />December 12, 2017 and February 8, 2018 to review the proposed development and receive <br />feedback from the community and adjacent property owners and residents. A total of seven <br />members of the public attended. The community raised concerns about safety, potential traffic <br />impacts, and the sale of alcoholic beverages. The sale of alcoholic beverages at this location is <br />not allowed per the City's alcoholic beverage ordinance. <br />On May 13, 2019, the Planning Commission held a public hearing to consider the project. At the <br />public hearing, the applicant expressed concerns with the mitigation measures and proposed <br />conditions of approval. The applicant's concerns and their resolutions are listed below: <br />(a) Concern: Transportation Mitigation Measure No. 1 restricting access driveways along Daisy <br />Avenue to left -in, right -in and right -out only. <br />Resolution: The applicant submitted a revised traffic site analysis (TSA), attached hereto <br />within Exhibit 13, to address and correct the southerly Daisy Avenue driveway restrictions. <br />The revised TSA was reviewed and approved by the City's Public Works Agency. In <br />addition, the Final MND has been revised to reflect this change and Transportation Mitigation <br />Measure No. 1 has been removed. <br />(b) Concem: Condition No. 4 of the CUP requiring an alternative trash enclosure location/design <br />that complies with the Crime Prevention Through Environmental Design (CPTED) principals. <br />Resolution: The applicant submitted a revised site plan to address Condition No. 4 of the <br />CUP, attached hereto as Exhibit 7. The trash enclosure has been pushed to the rear of the <br />property along the south property line and the pedestrian walkway leading from Daisy <br />Avenue to the front of the convenience store is now located in front of the trash enclosure. <br />The revised site plan has been determined to be acceptable by staff and, therefore, the <br />condition has been removed. <br />1-3 <br />
