Up to 48 hours of this personal necessity leave may be used: a) to attend to a serious <br />accident to members of the employee's immediate family; b) childbirth; c) to cope <br />with imminent danger to the employee's family, home, or other valuable property; <br />d) when the existence of external circumstances beyond the employee's control <br />make it impossible for him or her to report for duty; or e) attend to medical or dental <br />appointments for members of the employee's household. For the purposes of this <br />section only, a "day" shall be defined as the number of hours of work that an <br />employee is required to work according to his or her specific workday schedule. <br />K. Payment for Unused Sick Leave (updated upon adoption of this MOU) <br />1. Except in cases of disability retirement, upon non -disciplinary termination of <br />employment: <br />2. Payment After Ten Years. After ten (10) years but less than fifteen (15) years of <br />cumulative full-time service with the City, each qualified employee shall be entitled <br />to payment for one-third (1/3) of the total accrued sick leave benefit credited into <br />his or her individual Retirement Health Savings (RHS) account upon the effective <br />date of such termination, not to exceed a maximum limit of four hundred and <br />twenty-seven (427) hours, at the base rate of pay effective on the date of such <br />termination. <br />3. Payment After Fifteen Years. After fifteen (15) years but less than twenty-five (25) <br />years of cumulative full-time service with the City, each qualified employee shall <br />be entitled to payment for two-thirds (2/3) of the total accrued sick leave benefit <br />credited into his or her individual RHS account not to exceed a maximum limit of <br />eight hundred hours (800) hours, at the base rate of pay effective on the date of such <br />termination. <br />4. Payment After Twenty -Five Years. After twenty-five (25) years but less than <br />thirty (30) years of cumulative full-time service with the City, each qualified <br />employee shall be entitled to payment for two-thirds (2/3) of the total accrued sick <br />leave benefit credited into his or her individual RHS account, not to exceed a <br />maximum limit of one thousand sixty-six (1066) hours, at the base rate of pay <br />effective on the date of such termination. <br />SANTA ANA MANAGEMENT ASSOCIATION (SAMA) MOU: 2019-2022 <br />55D-40 <br />
