Respondents found that there were a number of items that would result in a <br />significant impact on the environment and it was only less than significant with mitigation <br />measures that would be imposed as part of the MND. Respondents found that absent the <br />mitigation measures the project would "cause a substantial adverse change in the significance of <br />an archeological resource," "directly or indirectly destroy a unique paleontological resource or site <br />or unique geological feature," and "disturb any human remains including those interred outside of <br />formal cemeteries." Respondents also found that absent required mitigation measures, the project <br />would "create a significant hazard to the public or the environment through the routine transport, <br />use, or disposal of hazardous materials," "create a significant hazard to the public or the <br />environment through reasonably foreseeable upset and accident conditions involving the release of <br />hazardous materials into the environment" and "emit hazardous emissions or handle hazardous or <br />acutely hazardous materials, substances, or waste within on -quarter mile of an existing proposed <br />school." <br />39. As part of the Original Project (as part of the Revised Project), 325 and 301 North <br />Tustin were to be graded and the MND and MMRP required Real Parties to hire an expert to <br />a CEQA analysis for any archaeological, paleontological or geologic discoveries and to <br />excavate them appropriately. Similarly, Real Parties were required to allow an archaeologist to <br />evaluate and perform any required analysis of any discovered burial sites or sacred lands. In <br />addition, prior to commence of construction, Real Parties were required to "retain a Native <br />American Monitor to conduct a Native American Indian Sensitivity Training for construction <br />personnel' and "retain a Native American Monitor to be on -site during all project related, ground <br />disturbing construction activities (e.g. pavement removal, auguring, boring, grading, excavation, <br />potholing, trenching, and grubbing)." <br />40. Prior to demolition, Real Parties were required to conduct an asbestos survey, to <br />remove all asbestos as required and prepare an abatement report.
