Further, as part of the Initial Study, Respondents were required to evaluate whether <br />the project would result in exposure of persons to or generation of excessive groundborne <br />vibrations or noise levels, if the project would expose people or generate noise levels in excess of <br />standards established in the local general plan or noise ordinance, or applicable standards of other <br />agencies, and whether the project would create a substantial temporary or periodic increase in <br />ambient noise levels in the project vicinity above levels existing without the project. Respondents <br />conducted these evaluations as part of the Initial Study for the retail building, not the car wash. <br />Based on the retail building (and without considering a car wash), Respondents found these items <br />to have a less than significant impact. <br />D. Respondents Approve the Original Project Along with a Mitigated Negative <br />Declaration and Mitigation Monitoring And Reporting Program <br />42. In 2018, two years after the Original Project was proposed, Respondents prepared a <br />Mitigated Negative Declaration, Environmental Review No. 2016-156 for the Original Project (the <br />"MND"), as well as a Mitigation Monitoring and Reporting Program (the "MMRP"). The MND <br />concluded that the Original Project would have a less than significant environmental impact with <br />implementation of mitigation measures to address tribal and cultural resources, and hazards, <br />including asbestos and lead -based paint: <br />i. "The [Original] Project site will be graded prior to construction, and if <br />during grading, it is revealed that previously unidentified archaeological, <br />paleontological or geologic deposits exist, an expert appropriate to the <br />nature of the find must be afforded the opportunity to evaluate any <br />additional finds and to complete an analysis in accordance with CEQA <br />guidelines, as amended." <br />ii. "If future activities in project site adversely impact previously unidentified <br />cultural resources, including burial sites or sacred lands, an archaeologist <br />will be afforded the opportunity to evaluate any additional finds and to <br />complete an analysis in accordance with CEQA guidelines, as amended." <br />iii.
