EXHIBIT 1 <br />E. On March 5, 2019, the City Council approved a license agreement extension for two years to <br />expire on November 5, 2021 in order to ensure the license agreement does not lapse as the <br />City completes this process. <br />F. According to the Land Appraisal Report, the three replacement properties are of equal or <br />greater value in acreage and cost. The Recreational Value Report also indicates the three <br />replacement properties provide equal or greater recreational value based on the following: <br />a. The proposed replacement lands are of equivalent size. <br />b. The proposed replacement lands meet community park need by increasing residents' <br />walkable park access in a measureable way. <br />c. The proposed replacement lands meet policy and planning goals while satisfying <br />current recreation trends. <br />d. The proposed replacement lands offer recreational opportunities that satisfy current <br />community needs and desires. <br />G. The Proposed Project is required to undergo an environmental review pursuant to the <br />California Environmental Quality Act (Pub. Resources Code, § 21000 et seq.) ("CEQA"). A <br />Mitigated Negative Declaration and Initial Study (SCH #2019089067) (IS/MND) were <br />prepared for the project. Impacts related to aesthetics (light and glare), cultural resources <br />(ground disturbance), geology and soils (ground disturbance), noise (operational noise), <br />transportation (pedestrian crossings), and tribal and cultural resources (tribal and cultural <br />resources) are found to be less than significant with the implementation of mitigation <br />measures. The remaining environmental topics that were analyzed pursuant to CEQA were <br />found to have a less than significant impact or no impact. <br />H. The Notice of Intent to Adopt a Mitigated Negative Declaration was released on August 21, <br />2019 and the public review and comment period for the IS/MND ran from August 21, 2019 to <br />September 19, 2019. Public comments were received, the City responded to all written <br />comments submitted during the 30-day IS/MND public review period and no change to the <br />Initial Study/MND is necessary. All public comments and the City's responses thereto, are <br />incorporated herein by reference. <br />The mitigation measures set forth in the Mitigated Negative Declaration are specific and fully <br />enforceable and will be implemented using the Mitigation Monitoring and Reporting Program <br />("MMRP") attached hereto as Exhibit A, and incorporated herein by reference. The MMRP <br />adequately describes implementation procedures, monitoring responsibilities, reporting actions, <br />compliance schedule, and verification of compliance in order to ensure that the Project complies <br />with the adopted mitigation measures. <br />J. Federal Lands to Park Land Exchange Requirements indicate that replacement land must be <br />of equivalent fair market and recreational value. The City of Santa Ana prepared the <br />Recreational Value Assessment (RVA) for the three -replacement park sites in August 2018 to <br />provide justification of public recreational utility of the land proposed for exchange and its <br />replacement. The 2018 RVA concluded that the combined recreational value of the three <br />proposed sites are of equivalent recreation value in comparison with the Centennial <br />Educational Center Site at Centennial Park. Because NPS approval is required, an <br />Environmental Assessment (EA) has been prepared under a separate cover to satisfy the <br />requirement of NEPA and will be submitted as part of the City's submission to the National <br />Park Service. <br />K. On October 15, 2019, the City Council of the City of Santa Ana held a public hearing to <br />consider all testimony, written and oral, related to the IS/MND and the related MMRP for the <br />project, at which time all persons wishing to testify were heard, the project was fully <br />considered, and all other legal prerequisites to the adoption of this Resolution occurred. <br />#123890 7 5 C -6 <br />
