EXHIBIT 1 <br />Section 2. Pursuant to CEQA, the City Council has independently reviewed and analyzed <br />the information contained in the IS/MND prepared with respect to the Proposed Project, and all comments <br />received regarding the IS/MND. The City Council finds, based on the whole record before it, that the <br />IS/MND was prepared in compliance with CEQA and the State CEQA Guidelines (Cal. Code Regs., title <br />14, § 15000 et seq.), and the IS/MND adequately addresses the expected environmental impacts of this <br />project. Further, the City Council finds that there is no substantial evidence from which it can be fairly <br />argued that the project will have a significant adverse effect on the environment. The City Council also <br />finds that IS/MND reflects the independent judgement and analysis of the City Council. <br />Section 3. Based on its independent judgment and analysis, the City Council hereby adopts <br />and approves the IS/MND for the Proposed Project. <br />Section 4. The City Council hereby adopts the MMRP for the Proposed Project, attached <br />hereto as Exhibit A. Should there be any discrepancies in the mitigation measures provided in the <br />IS/MND and the MMRP, the measures in the MMRP shall control. <br />Section 5. Pursuant to Title XIV, California Code of Regulations (CCR) § 735.5(c)(1), the <br />City Council has determined that, after considering the record as a whole, there is no evidence that the <br />proposed project will have the potential for any significant adverse effect on wildlife resources or the <br />ecological habitat upon which wildlife resources depend. The proposed project exists in an urban <br />environment characterized by paved concrete, roadways, surrounding buildings and human activity. <br />However, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5, the payment of Fish and <br />Game Department filing fees in conjunction with this project is at the discretion of the State of California <br />Department of Fish and Wildlife. <br />Section 6. The City Council hereby adopts and approves the Centennial Park/Santa Ana <br />College Park Replacement Project. <br />Section 7. The City Council hereby directs staff to prepare and file a Notice of Determination <br />with the County of Orange County Clerk's Office within five working days of the approval of this <br />Resolution. <br />Section 8. The record of proceedings for the Proposed Project upon which this Resolution <br />and the City's determinations are based is located at the City of Santa Ana, Parks, Recreation, and <br />Community Services Agency, located at 20 Civic Center Plaza, Second Floor, Santa Ana, California <br />92702. The custodian of records is the Executive Director of the Parks, Recreation, and Community <br />Services Agency. <br />Section 9. The City Council hereby authorizes the submittal of the Centennial Park/Rancho <br />Santiago Community College District Park Replacement Park Project study and related environmental <br />documents to the National Park Service. <br />ADOPTED this _ day of October, 2019. <br />APPROVED AS TO FORM: <br />Sonia R.
