and City Council, transferring the deed conditions for the land upon which the <br />Education Center is located to new park sites of equal recreational value and <br />size. <br />D. On August 18, 2015, the College and the City entered into a reimbursement <br />agreement to reimburse the City up to $334,000 in costs associated with the <br />land conversion requirements for the replacement properties and take the <br />necessary actions to submit the required documentation to the NPS for a <br />determination. If approved by the NPS and the City Council, the use <br />restrictions could be removed from the license area and applied to the <br />replacement properties in order to allow the City and the College to enter into <br />negotiations for a long-term lease of the license area. <br />E. On March 5, 2019, the City Council approved a license agreement extension <br />for two years to expire on November 5, 2021 in order to ensure the license <br />agreement does not lapse as the City completes this process. <br />F. According to the Land Appraisal Report, the three replacement properties are <br />of equal or greater value in acreage and cost. The Recreational Value Report <br />also indicates the three replacement properties provide equal or greater <br />recreational value based on the following: <br />a. The proposed replacement lands are of equivalent size. <br />b. The proposed replacement lands meet community park need by <br />increasing residents' walkable park access in a measureable way. <br />c. The proposed replacement lands meet policy and planning goals while <br />satisfying current recreation trends. <br />d. The proposed replacement lands offer recreational opportunities that <br />satisfy current community needs and desires. <br />G. The Proposed Project is required to undergo an environmental review <br />pursuant to the California Environmental Quality Act (Pub. Resources Code, § <br />21000 et seq.) ("CEQA"). A Mitigated Negative Declaration and Initial Study <br />(SCH #2019089067) (IS/MND) were prepared for the project. Impacts related <br />to aesthetics (light and glare), cultural resources (ground disturbance), <br />geology and soils (ground disturbance), noise (operational noise), <br />transportation (pedestrian crossings), and tribal and cultural resources (tribal <br />and cultural resources) are found to be less than significant with the <br />implementation of mitigation measures. The remaining environmental topics <br />that were analyzed pursuant to CEQA were found to have a less than <br />significant impact or no impact. <br />H. The Notice of Intent to Adopt a Mitigated Negative Declaration was released <br />on August 21, 2019 and the public review and comment period for the <br />IS/MND ran from August 21, 2019 to September 19, 2019. Public comments <br />were received, the City responded to all written comments submitted during <br />the 30-day IS/MND public review period and no change to the Initial <br />Resolution No. 2019-090 <br />Page 2 of 6 <br />
