All public comments, and the City's responses <br />thereto, are incorporated herein by reference. <br />The mitigation measures set forth in the Mitigated Negative Declaration are <br />specific and fully enforceable and will be implemented using the Mitigation <br />Monitoring and Reporting Program ("MMRP") attached hereto as Exhibit A, and <br />incorporated herein by reference. The MMRP adequately describes <br />implementation procedures, monitoring responsibilities, reporting actions, <br />compliance schedule, and verification of compliance in order to ensure that the <br />Project complies with the adopted mitigation measures. <br />J. Federal Lands to Park Land Exchange Requirements indicate that <br />replacement land must be of equivalent fair market and recreational value. <br />The City of Santa Ana prepared the Recreational Value Assessment (RVA) <br />for the three -replacement park sites in August 2018 to provide justification of <br />public recreational utility of the land proposed for exchange and its <br />replacement. The 2018 RVA concluded that the combined recreational value <br />of the three proposed sites are of equivalent recreation value in comparison <br />with the Centennial Educational Center Site at Centennial Park. Because <br />NPS approval is required, an Environmental Assessment (EA) has been <br />prepared under a separate cover to satisfy the requirement of NEPA and will <br />be submitted as part of the City's submission to the National Park Service. <br />K. On October 15, 2019, the City Council of the City of Santa Ana held a duly <br />noticed public hearing to consider all testimony, written and oral, related to the <br />IS/MND and the related MMRP for the project, at which time all persons <br />wishing to testify were heard, the project was fully considered, and all other <br />legal prerequisites to the adoption of this Resolution occurred. <br />Section 2. Pursuant to CEQA, the City Council has independently reviewed <br />and analyzed the information contained in the IS/MND prepared with respect to the <br />Proposed Project, and all comments received regarding the IS/MND. The City Council <br />finds, based on the whole record before it, that the IS/MND was prepared in compliance <br />with CEQA and the State CEQA Guidelines (Cal. Code Regs., titl 14, § 15000 et seq.), <br />and the IS/MND adequately addresses the expected environmental impacts of this <br />project. Further, the City Council finds that there is no substantial evidence from which it <br />can be fairly argued that the project will have a significant adverse effect on the <br />environment. The City Council also finds that IS/MND reflects the independent <br />judgement and analysis of the City Council. <br />Section 3. Based on its independent judgment and analysis, the City Council <br />hereby adopts and approves the IS/MND for the Proposed Project, <br />Section 4. The City Council hereby adopts the MMRP for the Proposed <br />Project, attached hereto as Exhibit A. Should there be any discrepancies in the <br />mitigation measures provided in the IS/MND and the MMRP, the measures in the <br />MMRP shall control. <br />Resolution No. 2019-090 <br />Page 3 of 6 <br />
